<br />Planning and Zoning Commission Minutes <br />Aoril 21. 2005 . <br /> <br />Pace 32 <br /> <br /> <br />parcels that allowed him two acres. They wrote him up for 1.2 acres and sent <br />him a letter saying if he did not pay the fine of $1,000 it would not stop them <br />from imposing further fines so he went ahead and paid the fine and the $1,060 <br />erosion fee. He said this is not his erosion it was there when he bought the <br />property. <br /> <br />Mr. Hill said this is in the Midland Area Plan, it went before the Midland Planning <br />and Zoning Board and they voted it down 4 to O. If that Midland Area Plan does <br />not mean anything ~nd can be altered against the wishes of the area that it <br />concerns, then none of the area plans mean anything. Mr. Hill said he think we <br />have to respect the Wishes of the people in that area. That has always been his <br />concern that once we violate these area plans we just as well scrap them all. <br /> <br />The Chair said he has set through all of this with Mr. Misenheimer and his <br />concern is this thing started out as a small private personal concrete plant. He <br />said looks like the sky, is the limit to him. It looks like it has escalated in just the <br />three meetings we h~ve had much less once it gets going he does not know <br />what it might eventually grow into. <br /> <br />Mr. Starnes said he just hate to see a man have a local business, he said <br />personal, but he think that was kind of a general statement, he think he meant <br />more personal for his 'commercial development. He said he does not think he is <br />looking at going to broad of a commercial development. Mr. Starnes said <br />considering the area ithere are commercial businesses up and down Highway <br />24/27 and you have tractor trailers going up and down the highway. He said <br />when this board start$ looking at commercial development and turning it down, <br />even if it is a small bU$iness man, he think you are kindly looking at trouble. Mr. <br />Starnes said this is opportunity for people to work. He understands what Mr. Hill <br />says here Midland PIc1nning and Zoning turned this down and it is not part of <br />Midland's plan. Mr. S~arnes said its got to be a fine line there he does not think <br />it out rightly violates [ it. He said he thinks it is still part of the commercial <br />development there. <br /> <br />The Chair closed the Public Hearing Petition C05-02(R-CU). <br /> <br />There being no furtMr comments Mr. Starnes MOTIONED to approve Petition <br />C05-02(R-CU) with st~ff recommendations. (1) It must comply with submitted <br />site plan and (2) It njust comply with list of approved uses, seconded by Mr. <br />Griffin. The vote was $ to 4. Mr. Divine, Mr. Griffin, Mr. Moore, Mr. Moose and <br /> <br />G-5 <br />
