<br />utilities of the Center shall be obstructed by Lessee nor used for any purpose other than for <br />ingress to and egress from the Leased Premises. . Lessee shall not obstruct doors, stairways, <br />house lighting attachments an<;i other structures, which are a part of the Leased Premises. Water <br />closets and water apparatus will not be used for any purpose other than that for which they were <br />constructed, and no sweeping$, rubbish; rags, paper or other substances shall be thrown therein. <br />Lessee shall inunediatèly pay for any damage resulting from misuse of any nature or character of <br />Center property of any kind or,description. <br /> <br />24. ADVERTISING. The Lessee agrees that all advertising of this event will be honest and true <br />and will include accurate infonnation on the Event time, ticket price, etc. The Lessee will <br />identify the facility as the "Cabarrus Arena & Events Center". No advertising or publicity may <br />state that the Lessor sponsors or is responsible for the Lessee's activities during the period of <br />use. <br /> <br />,I,) <br />25. RADIO AND T.V. It is .greed that Lessee shall have the exclusive right to negotiate and <br />enter into agreements for the! granting of radio and television rights in connection with the <br />staging of any Event under the tenns of this lease, provided, however, any and all revenue from <br />said radio, television or other rights so granted shall be included in the gross receipts for such <br />Event in the same manner as the receipts from ticket sales and Lessor shall be entitled to the <br />same percentage thereof. <br /> <br />26. COPYRIGHTED MATERIAL. Lessee shall assume all costs and obligations arising from <br />the use of patented and/or copyrighted materials, equipment, devices, processes or dramatic <br />rights f\m1ished or used or incorporated in the conduct of the Event. Lessee agrees to indemnify <br />and hold harmless the Lessor ¡and its duly authorized representatives from all damages, costs, <br />expenses, including attorney's fees, for .or on account of the use of any patented and/or <br />copyrighted materials, equipment, devices, processes or dramati.c rights furnished or used by the <br />Lessee in connection with an Event. Lessee shall be solely and exclusively responsible for <br />procuring, maintaining and paying for all appropriate BMI, ASCAP, and SESAC or any other <br />required licenses or pennits for Event(s) and hereby indemnifies and holds harmless Lessor from <br />and against any and all damages, costs, liabilities, damages and expenses (including without <br />limitation, attorneys' fees and other legal costs) arising out of or attributable to Lessee's failure <br />to comply with this requirement. This indemnity shall survive tennination of this agreement. <br /> <br />27. OTHER RIGHTS. Lessor reserves all rights not specifically granted to Lessee under the <br />tenns hereof. <br /> <br />28. ALCOHOLIC BEVERAGES. Lessor's concessionaire has- sole right to the sale and <br />distribution of alcoholic beverages within the Leased Premises and Lessee shall not pennit any <br />alcoholic beverages to be brought onto the Leased Premises. <br /> <br />29. CATERING. The Center provides exclusive, in-house catering at an additional cost. Lessor <br />prohibits the carrying in of food and beverage items by anyone not affiliated with Lessor's <br />chosen caterer.
