Catering services include, but are not limited to sit down meals, box lunches, or any other food or beverages not defined as a part of the standard concession operations. 30. NO FREE MERCHANDISE. Neither Lessee nor Lessee's exhibitors shall give away nor sell items under the terms of this lease without written permission from the Lessor. 31. PROGRAMS AND NOVELTIES. The Lessee shall have the sol~ right to print and sell ABA approved game Programs or other similar novelty ABA approved merchandise during the Events. Only ABA approved and sanctioned merchandise shall be sold. Sale of such merchandise shall be arranged with Lessor in advance. Lessee must furnish all labor and will be allowed to sell such items from one mutually agreed location only. The Center maintains a non-exclusive, non- discriminatory, open decorating arrangement whereby pre-qualified decorating companies are available to the Center's Lessees. The Lessee may select from this list of qualified decorating . . companIes. Decorating shall mean any decorating service, to include but not be limited to freight and equipment. handling, provisions for tables, chairs, drapery, carpeting, table. shirting, where guaranteed quantities have been made by the Lessee at an established price, or whereby the decorating firm agrees to provide such services in such a manner as to provide sufficient service to meet its obligation established by its contract with Lessee. The decorating fee to be paid by the decorating organization to the Center (which remains the exclusive property of the Center) shall be computed on the basis of the rental cost of equipment plus labor expense times the Center's percentage, twenty percent (20%) less sales tax. 34. EXTRA HELP. The handling of the baggage, supplies or equipment of Lessee shall be the sole responsibility and at the sole expense of Lessee. In case it shall be necessary to employ extra help such as public address system operators, janitors, and clean-up personnel, Lessee must either provide such personnel at its expense or notify Lessor at least thirty (30) days in advance of the need for such personnel. If such personnel are provided by Lessor, it shall be at the sole expense of Lessee. If such personnel is provided by Lessee, Lessee shall be solely responsible for ensuring that the hired personnel has the necessary training and skills to perform such services. In the event any property at the Center is damaged due to the actions of such personnel, Lessor shall be entitled to charge Lessee for the costs of repair or replacement property. £..3
