<br />" <br /> <br />STATE OF NORTH CAROLINA, <br />COUNTY OF CABARRUS . , <br /> <br />, , <br />MEMO RAND TIM <br />OF <br />, UNDERSTANDING <br /> <br />TIllS MEMORANDUM OF UNDERSTANDING is made and entered into on this, the date <br />shown at the conclusion of this document by and between Cabarrus County, a body politic and <br />corporate of the State of North Carolina("County") and the City ofKannapolis, a North Carolina <br />municipal corporation ("City"). <br /> <br />WHEREAS, County is' experiencing explosive residential growth, particularly in ,the' <br />northwestern portion of county, and ' <br /> <br />WHEREAS, it is in the long-term interests of all the citizens of County and City to have a <br />synchronized, progressive, cooperative and comprehensive' approach to land use and growth' <br />, management; . <br /> <br />NOW THE~FORE, City and County hereby agree as follows: <br /> <br />1) City and County shall endeavor to develop a' comprehensive land use/growth <br />management plan, along with the City of Concord, for Northwest Cabarrus County (defined <br />below), using the Highway 73 Corridor Study as a basis. Planning will begin immediately and is <br />to be completed and implemented, including adoption of any desirable ordinances, within six <br />months. Northwest Cabarrus County is the unincorporated portions of Cabarrus County being <br />those portions of Townships 2,3 and 4 located north of 1-85. <br /> <br />"C' . ,v . .. ': ,': . <br /> <br />2) County will immediately institute the process required to impose a moratorium on' <br />,the approval of residential subdivision applications in the unincorporated areas of the county, <br />The moratorium shall have a duration of 6 months. During the moratorium, County shall prepare <br />new development and zoning ordinances substantially similar to those in use in Mt. Pleasant, <br />Harrisburg, Concord and Kannapolìs. These new ordinances shall be adopted at or before the <br />end of the moratorium. ' <br /> <br />3) All residential developments submitting preliminary applications to City or <br />preliminary subdivision plats to County prior to the enactment of the moratorium' shall be <br />permitted to proceed to approval through the development review process under the ordinances <br />and regulations in effect at the date of execution of this Memorandum. Nothing in this document <br />shall be construed to relate to, or affect commercial or industrial development. ' <br /> <br />4) City hereby endorses County' s effort to revise its development ordinances and will <br />support implementation thereof <br /> <br />" <br /> <br />5) County hereby endorses City's efforts to secure legislation by the North Carolina <br />General Assembly that would . permit City to voluntarily annex property located within the <br />Kannapolis Annexation Area pur~uant to the Annexation Agreement executed between City and <br /> <br />10f2 <br />F-4- <br />
