Failure to meet iniplementation dates may result in a penalt3' of $100.00 per da)' tmtil <br /> completed if willfully negligent. Tin~ table elements of Agency audits are also included. <br /> <br />ARTICLE II. CCTS's DUTIES AND OBLIO~ATIONS: <br />A. CCTS shall provide overall directio~ and administration of the system via tho Mobilit3' Management liason. <br /> CCTS will xvork closely and cooperatively with the Contractor to design and implement the system's policies, <br /> services, contractual and rate struettl'es so as to minimize cost, improve service quality, maximize efficiency, <br /> and to meet the system's goals of exp~ding transportation options within the community. <br /> <br />B. CCTS shall ensure that agencies p~'ticipate in the system using coordinated contracts as provided in the <br /> Transportation Memorandum of U[derstanding section of the Community Transportation Program Grant <br /> application, acceptable in form to ~oth CCTS and the Contractor. All existing and future eontxacts: sub- <br /> contracts; or operating MOU's bet~veen agencies, counties, governments, private entities or individuals by <br /> CCTS or the Count)' MIl be cumulative additions absorbed into the rate structure applicable at that time. <br /> <br /> C. CCTS shall enter into such service a~reements with participating agencies establishing per-passenger, per:mile, <br /> per-hour, sponsorship, or other mm {truc-tures as ma)' be appropriate. It is CCTS's intent that agency payments <br /> from these service agreements will ~over the majofit3' of the costs of operating CCTS transportation, curs <br /> Rural General Public transportation ~s to be funded by RGP grants and fares collected from Communit3' Transit <br /> passengers. CCTS also intends to e:~plore establishing additional cooperative agreements with Cabarms Comet)' <br /> government, the Cit3' of Concord, ar~a employers, and other organizations in efforts to expand mobility choices <br /> within. Ibc community. ; - <br /> <br />D. CCTS shall provide a sufficient nungber of vehicles to operate the demands of the system, and will lease these <br /> vans to the Contractor at the rate {$f One Dollar ($1.00) per van, per )-ear. CCTS shall be responsible for <br /> preparing NCDOT grants, and for ~e management of capital surcharges and/or other revenue sources, so as to <br /> · <br /> provide the necessary capital eqmp_lnent for the operation of the system except as Rrovided under Article I - <br /> Section I above. CCTS reserves th~ right to provide the system's computer hardware and softxvare, and other <br /> equipment as needed, under similar ..[ease arrangements to the contractor or to reflect this provision of service in <br /> the-e:ontracted rate for service. <br /> <br /> E. CCTS shall endeavor to provide repiacement vehicles as each vehicle reaches NCDOT's minimum threshold for <br /> replacement age/mileage· It is understood that all replacement vehicle request must be approved by the <br /> NCDOT/PTD prior to replacement~ Should the contractor be required to operate vehicles exceeding these <br /> tlu'esholds, then CCTS shall indemnll_' f3' the Contractor from financial liabilit3' for major repairs necessary to the <br /> engines, transmissions, ?dC systems, or ~vheelchair lif~ systems on such vehicles that have passed the <br /> replacement threshold providing all haaintenance of concerned vehicles of the fleet is cun'ont and only xvhen the <br /> contracted maintenance costs of 15 ~ents per mile aggregate has been exceeded for the CCTS system. CCTS and <br /> the Count3' reserve the right to pro, de or subcontract this function if service or costs of service are determined <br /> to be best served outside of this cohtract, proportioned adjustment to contract rate would be implemented per <br /> contract. <br /> <br /> F. CCTS shall provide a two-way radi~ system including mobile radios for each vehicle, a base station, hand-held <br /> radio, back-up mobile units, etc. C~TS will transfer all existing system equipment to the Contractor including <br /> on-board emergency equipment, fl _~,'t maintenance records, and operational equipment and records as ma)' be <br /> available. Contractor will maintain ~ Nextel phones (reimbursed at approved Count)' rate and service plan).. <br /> <br /> <br />
