rules, regulations, ordinances, guidelines and policies and currently approved methods, <br />standards of practice and codes of ethics in the medical service community. The Provider <br />represents and warrants to the County that it is an equal employment opportunity employer and <br />is (and will remain, for the life of this Agreement) in full compliance with any and all applicable <br />anti-discrimination laws, rules, and regulations. The County and the Provider agree not to <br />harass, discriminate against or retaliate against any employee due to their national origin, age, <br />sex, religion, disability, marital status or other category protected by law, <br />nor shall either party cause or request the other party to engage in such discrimination, <br />harassment or retaliation. In [he event of any complaint of unlawful discrimination, harassment <br />or retaliation by any employee of either party involving an employee of the other party, the <br />County and the Provider agree to cooperate in the investigation and attempted resolution of <br />such complaint. : <br /> <br />D. Record Maintenance. The Provider will maintain detailed records and reports which <br />constitute Client's records, including notes and personal observations of the Client's progress <br />and notification of planned visits. <br /> <br />E. Confidentiality. The Provider will maintain the confidentiality of all records and information <br />in accordance with all applicable federal, state and local laws, rules, regulations, ordinances, <br />guidelines and policies applicable to the Provider, including without limitation, the Healthcare <br />Insurance Portability and Accountability Act. <br /> <br />F. Provider Employee Qualifications. The Provider will maintain on file verification of the <br />qualifications of all Provider personnel, including without limitation, the following: <br /> <br />1. Current applications of alllProvider employees. <br />2. Current Nursing Assistant i("NA") I listing, when applicable. <br /> <br />3. Results of annual Tuberculosis test for each Provider employee. If the individual has a <br />positive Tuberculosis test, there must be annual documentation (chest x-ray) from a physician <br />that he/she is free of communicable disease. <br />4. Evidence of Hepatitis B vaccine or appropriate signed release form from each Provider <br />employee. <br />5. Documentation of self ~kills assessment of each Provider employee at the time each <br />employee is hired. <br />6. Documentation of initial OSHA Bloodborne Pathogens and universal precautions training <br />provided to each Provider employee. <br /> <br />G. Background Checks. The Provider will conduct criminal records checks of all Provider <br />personnel in accordance with ~Xlorth Carolina laws and regulations. <br /> <br />H. Non-Discriminatory Practices. Provide will provide the Services to the Clients without <br />regard to the Client's race, religion, sex, age, national origin or disability. <br /> <br />2 <br /> <br /> <br />
