o <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />The Customer agrees to accept and abide by all rules, operating <br />regulations, practices, collections, liabilities and all other aspects, as they <br />are now written and as they may be changed from time to time in the tariff <br />of the Company as approved by the North Carolina Utilities Commission. <br /> <br />The Customer agrees to reimburse the Company for any and all <br />equipment loss caused by any improper handling or abuse of any part of <br />the Facilities by the Customer and/or his agents or representatives. <br /> <br />The Facilities shall be used for the sole and exclusive use and benefit of <br />the Customer, consistent with all applicable tariffs, unless otherwise <br />agreed to in writing by the Company. <br /> <br />The Company agrees to install th~ Facilities in a workman-like manner. <br /> <br />The Company agrees to maintain the Facilities during its normal course of <br />operation in a prompt and efficient manner. <br /> <br />In the event the service is terminated by the Customer prior to the <br />expiration of the initial term, the Customer agrees to pay to the Company <br />an amount equal to the cost of the,Monthly Fee times the remaining <br />months of the Agreement as liquidated damages. This termination fee <br />shall not apply if the Facilities are to be upgraded by both parties <br />concerned and a new agreement is thereafter entered into. This <br />termination fee shall not apply if the customer dissolves their business or <br />moves out of the Company's serving area. This termination fee shall not <br />apply if the Company develops new pricing options that are more <br />favorable for the Customer should the Customer elect to take advantage <br />of the Company's most favorable rates for comparable service and a new <br />agreement is thereafter entered into. Termination fees will apply to any <br />service that is transferred to a competitive local service provider. <br /> <br />Until otherwise notified by the cuStomer, the billing address for the service <br />shall be as follows: <br /> <br />Cabar ,rps County Government <br />PO Bo,x 707 <br /> <br />Conco¢, NC 28026-0707 <br /> <br />The Company reserves the right to maintain and upgrade the Facilities <br />and to operate the same from time to time in such manner as will best <br />enable it, in its sole judgment, to meet the needs of its customers and <br />fulfill its own service requirements. <br /> <br />2 <br /> <br /> <br />
