Also, subject to fight-of-way for said <br />North Carolina I-Iighway 7:3. <br /> <br /> TO HAVE AND TO HOLD the Demised Premises .upon those conditions and with those privileges set <br />forth herein for the term herein set forth, subje~ to the following covenants and conditions: <br /> <br /> 1. Term: The tenancy hereby demised shall commence on <br />the,._.___day of January, 200~ and shall continue for a period of twenty five (25) years, unless sooner <br />terminated as herein provided. ' <br /> <br /> 2. Rental: The Tenant shall pay to the Landlord. as rental for the Demised premise~, the sum of'One <br />Dollar ($1.00) per year. Such annual rental shall be paid, in advance, to Landlord on or before the first (1) day <br />of J'uly of each and every year beginning.on the 1st day of July, 2001. Utilifie,; The Tenant shall pay all charges for telephone, electricity, water, gas and other utilities used <br />by Tenant on the Demised,Premlses. Landlord shall provide Tenant with access to such utilities as are needed at <br />all times at Tenant's expense. <br /> <br /> 4. Tenant's Repairs: Upon acceptance of thc Demised Premises by Tenant, Tenant shall keep the <br />Demised Premises, in good condition and repair, and in compliance with-any applicable government <br />regulations. ~ <br /> <br /> 5. Landlord's Obligation: Tile above described property is leased "AS-IS, WHERE-IS" and Landlord <br />makes no warranties or representations regarding the title, existence of liens and encumbrances, or whether the <br />property is suitable for the Tenant's intended uses. <br /> <br /> 6. Signs. Fixtures. and Alterations: Tenant, at its own expense, may from time to time dUring the term of <br />this Lease, make any alterations, install fixtures or signs which it may deem necessary or desirable to the <br />premises and the intended Use of the premises ,such improvements shall be made in a good workmanlike <br />manner and in accordance with all valid requirements of Municipal or other Governmental authorities. Tenant <br />shall have the right to remove ~ or anY part of the Tenant's equipment, fixtures, or signs from the Demised <br />Premises at. any time, provided Tenant shall repair or reimburse Landlord for the cost of repairing any damage <br />to the Demised Premises resulting from the installation or removal of such items. Landlord shall have the fight <br />to approve aR signs installed by Tenant. <br /> <br /> 8. Quiet Enjoyment: The Landlord covenants, warrants, and represents that it has full power and right to <br />execute and perform this Lease and that the Tenant, upon paying the rent herein reserved and performing thc <br />covenants and agreements hereof shall peaGefully and quietly have, hold, and enjoy the Demised Premises and <br />all rights and privileges belonging, or in any way appertaining, thereto during the full term of this Lease and any <br />extension thereof. <br /> <br /> 9. Default: In the event cfa default in the payment of the rental provided for herein or in the event of <br />any breach by Tenant in the performance of any of the other covenants and conditions herein contained to be <br />kept and performed by Tenant, and, if such default or breach shall continue for ten (10) days after written notice <br /> <br /> <br />
