· a statistical summary showing agencies participating, miles driven, trip performance data, system costs, <br /> surcharges, average fuel costs, breakout of rates charged per <br />· other information as appropriate for CCTS Board consideration as detailed in the Records and Keports Section <br /> of the RFP. <br />· It is also understood and agreed that the contractor will comply with all time table elements of the CCTS CT[P <br /> implementation. Failure to meet implementation dates will result in a penalty of $100.00 per day until <br /> completed. <br /> <br />ARTICLE II. CCTS's DUTIES AND OBLIGATIONS: <br />A. CCTS shall provide overall direction and administration of the system. CCTS will work closely and <br /> cooperatively with the Contractor to design and implement the system's policies, services, contractual and rate <br /> structures so as to minimize cost, improve service quality, maximize efficiency, and to meet the system's goals <br /> of expanding transportation options within the community. <br /> <br />B. CCTS shall ensure that agencies participate in the system using coordinated contracts as provided in the <br /> Transportation Memorandum of Understanding section of the Community Transportation Program Grant <br /> application, acceptable in form to both CCTS and the Contractor. All existing and future contracts; sub- <br /> contracts; or operating MOU's between agencies, counties, governments, private entities or individuals by <br /> CCTS or the County will be cumulative additions absorbed into the rate structure applicable at that time. <br /> <br />C. CCTS shall enter into such service agreements with participating agencies establishing per-passenger, per-mile, <br /> per-hour, sponsorship, or other rate structures as may be appropriate. It is CCTS's intent that agency payments <br /> from these service agreements will cover the majority of the costs of operating CCTS transportation. CCTS <br /> Rural General Public transportation is to be funded by RGP grants and fares collected from Community Transit <br /> passengers. CCTS also intends to explore establishing additional cooperative agreements with Cabarrus County <br /> government, the City of Concord, area emPloyers, and other organizations in efforts to expand mobility choices <br /> within the community. <br /> <br />CCTS shall provide a sufficient number of Vehicles to operate the demands of the system, and will lease these <br />vans to the Contractor at the rate of One Dollar ($1.00)per van, per year. CCTS shall be responsible for <br />preparing NCDOT grants, and for the management of capital surcharges and/or other revenue sources, so as to <br />provide the necessary capital equipment for the operation of the system except as provided under Article I - <br />Section I above. CCTS reserves the fight to provide the system's computer hardware and software, and other <br />equipment as needed, under similar lease arrangements to the contractor or. to reflect this provision of service in <br />the contracted rate for service. <br /> <br />CCTS shall endeavor to provide replacement' vehicles as each vehicle reaches NCDOT's minimum threshold for <br />replacement age/mileage. It is understood that all replacement vehicle request must be approved by the <br />NCDOT/PTD prior to replacement. Should the contractor be required to operate vehicles exceeding these <br />thresholds, then CCTS shall indemnify the Contractor from financial liability for major repairs necessary to the <br />engines, transmissions, .MC systems, or wheelchair lift systems on such Vehicles that have passed the <br />replacement threshold providing all maintenance of concerned vehicles of the fleet is current and only when the <br />contracted maintenance costs of 15 cents per mile aggregate has been exceeded for the CCTS system. CCTS and <br />the County reserve the right to provide or subcontract this function if service or costs of service are determined <br />to be best served outside of this contract. Proportioned adjustment to contract rate would be implemented per <br />contract. <br /> <br />Fo <br /> <br />CCTS shall provide a two-way radio system including mobile radios for each vehicle, a base station, hand-held <br />radio, back-up mobile units, etc. CCTS will transfer all existing system equipment to the Contractor including <br />on-board emergency equipment, fleet maintenance records, and operational equipment and records as may be <br />available. <br /> <br /> <br />
