SERVICE AGREEMENT <br /> FOR <br /> NORTH CAROLINA SPECIAL OLYMPICS <br />IN CABARRUS COUNTY, NORTH CAROLINA <br /> <br /> THIS AGREEMENT, effective January 1, 2000, between Cabarrus County Schools <br />("Schools"), whose mailing address is Post Office Box 388, Concord, NC 28026-0388, and <br />Cabarrus County, North Carolina, a political subdivision of the State of North Carolina (herein <br />known as the "County") whose mailing address is Post Office Box 707, Concord, NC 28026~ <br />0707. <br /> <br /> WHEREAS, the parties have a common interest in the North Carolina Special Olympics <br />for the County residents (hereafter the "Program") and the health and well being of exceptional <br />population of the County; and <br /> <br /> WHEREAS, the parties desire to provide for the continued administration of the Program <br />throughout the County; <br /> <br /> NOW THEREFORE, in consideration of the premises and other good and valuable <br />consideration, the parties hereby agree to the following terms and conditions: <br /> <br /> 1. Administration of Program. The Program has historically been administered by <br />the Cabarrus County Parks and Recreation Department (the "Department") and will be <br />henceforth administered by the Schools. <br /> <br /> 2. Term. The initial term of this Agreement is five (5) years beginning January 1, <br />2000 and ending June 30, 2005. The parties may renew this agreement for a five (5) year period <br />beginning July I, 2005, upon notification in writing by either party to the other by May 1, 2005. <br />Terms of any renewal will be agreed and entered into by the fifteenth day of June, 2005. <br /> <br />COUNTY OBLIGATIONS <br /> <br /> 1. Records. The County will provide the Schools with all past records, products and <br />equipment (~vhich includes one computer) used by the County for the Program, including <br />without limitation, any supplies, files, forms, awards, notebooks, video tapes, banners, games, <br />equipment and other miscellaneous materials pertaining to the Program in the possession of the <br />County. The County will arrange for the Schools to obtain the software computer program <br />(Microsoft Access Data Base) used by the County to enter and produce needed items for the <br />Program. <br /> <br /> 2. Advertising. The County will allow the Schools access to certain Program <br />advertising vehicles reasonably available to the County, including providing access to the <br />County governmental access channel (currently Channel 25 on Time Wamer Cable). <br /> <br /> <br />
