Memo <br /> <br />To-' Cabarrus County Board of Commissioners <br /> <br />From:Jonathan Marshall, AICP <br /> <br />CC-' Frank Clifton, County Manager <br /> <br />Date= 03/14/00 <br /> <br />Re= Petition C00-02® <br /> <br />This petition is for a special use rezoning and requires sworn testimony. As a special <br />use petition it also requires expert testimony and permits cross examination and the <br />inclusion of conditions when supported by factual evidence and agrccd upon by the <br />petitioner. <br /> <br />The Board of Commissioners should include Findings of Fact to support their <br />decision and any conditions that may be proposed to the petitioner. <br /> <br />Staff has recommended approval based on the following facts deter-mined from the <br />petitioner's submission, previous public review, and staff analysis: <br /> <br />The proposed development will impact area transportation systems, but these <br />effects are mitigated by improvements that the petitioner has agreed will be a <br />condition of this rezoning. This fact is supported by the Traffic Impact Analysis, <br />NCDOT review of that analysis, and the petitioners testimony will also support it. <br /> <br />o <br /> <br />Mixed uses within the development will lessen the traffic impacts of the overall <br />development. This statement is supported by the submitted Traffic Impact <br />Analysis and will be affirmed by expert testimony. <br /> <br />School enrollment impacts will be addressed through the previous property <br />agreements the petitioner has reached with the Board of Commissioners.
