StaffAnalysis: Commission Action: Staff finds &at the preliminary subdivision plat meets all the development standards of the Cabarrus County Subdivision Ordinance. To meet the Adequate Public Facilities and Recreational Areas r~quirements of the Cabarms County Subdivision Or,ilnance the applicant has proposed to construct 75% of the Upper Muddy Creek sanitary sewer interceptor at a total proposed public benefit of $618,000. This line will eventually serve thc Bethel Elementary School replacement site. This site is also proposed for a school park. Letters, f~om the T.L. Harrell Land Development Co., Inc. (Sept. 29, 2000), Don Clickner (Sept. 28, 2000), and Mark Laml~ert (Sept. 29, 2000) are attached addressing this issue. The Cabama County planning Commission voted to deny the subdivision based on the Adequate Public Facilities section of the Cabarras County Subdivision Regulations and because several technical comments were not addressed on the plat by the applicant. The applicant is appealing th~ decision of the planning CommlssiolL Letter attached from Robert Mullen with LandDesign, Inc. StstT Recommendation: The applicant has sufficiently addressed all technical comments so it is therefore recommended that the subdivision be C. ONDITIONALLY APPROVED. The recommended condition is: That a consent agreement be entered i~to 10etween tho Cabarrus County Board of Commissioners and the applicant. The content of thc consent agreement should be based on the attached letter dated September 29, 2000 and submitted by the T.L. Harrell Land Development Co., Inc.
