23. 4.10.5.1.1.1 States that TNDs can not be bisected by arterial streets. The Village of Lake Park is <br /> bisected and is a very successful planned traditional community. <br /> <br />This is now 4.10.7.1.1. This refers to existing arterial streets. Language in this section <br />should read rainor or major thoroughfare to match road designations of our transportation <br />planning documents and to provide more clarity. Lake Park Includes some arterial or <br />collector streets but was not bisected by an existing major or minor thoroughfare. <br /> <br />24. 4.10.5.3.4,5 Again, I would suggest that have so many restrictions and detail requirements will <br /> eliminate free-market decisions and individuality of these new communities. In general, thc TND is a <br /> great concept and should become preferred for large enough developments. Under the regulations of <br /> this whole section it becomes very stringent. <br /> <br />In general, if someone were to propose a true TND project they would comply with these <br />regulations and may go even further than these minimum standards. If someone would like <br />to do a mixed-use project, they could also apply for a PUD, which provides more flexibility <br />than the TND standards. The purpose for these design standards is to ensure that these <br />developments are attractive pedestrian friendly areas. <br /> <br />25. 4.10.5.5.4 Can some of the 75% parking in rear of the building be amended to allow it next to the <br /> building also? <br /> <br />In a TND, as in Downtown Concord or Cannon Village in Kannapolls, parking should be <br />minimized and be out of site. This allows some parking to be located in the front or side and <br />doesn't include on-street parking that will serve TND developments. In addition, If a use <br />fronts on a thoroughfare adjacent to the TND then parking may front the thoroughfare. <br /> <br />26. 4.10.6.4.3 TND Infill - why are front porches required on all single family dwelling units? Why not <br /> be more market driven? <br /> <br />The most current version requires them on 70% of ali single family dwellings. The purpose <br />for these design standards is to ensure that these developments are attractive pedestrian <br />friendly areas. Again, a TND district is voluntary and only done upon application of a <br />landowner <br /> <br />27. 4.10.6.4.5.2 Seems very confusing. What is the 24 height requirement and why do you have to use <br /> buildings across thc street not on your property to establish enclosure ratios? <br /> <br />28. 4.11 <br /> <br />Enclosure ratios are a very important element of urban design. Try to imagine downtown <br />Concord with five story narrow buildings on one side of the street and one story very wide <br />ranch type buildings on the other side, it just wouldn't look right. To ensure that new <br />development compliments existing development, buildings across the street are used to <br />establish the enclosure ratio. The 24 foot height requirement is used to establish minimum <br />enclosure ratios when land across the street is vacant. <br /> <br /> Are there any Transit Oriented Development Districts? <br /> <br />· Initially this overlay district will not be mapped. Once a transit plan is completed it will be <br /> used at key transit stops and/or stations. <br /> <br />29. 4.13 There are some existing pre-existing non-conforming uses that will be affected by the <br /> airport overlay.
