NCACC PROPOSED LEGISLATIVE GOALS Page 3 of 5 <br /> <br /> the system operated by tax administrators and alIow a lien to be placed on the pmpea7 as an effective <br /> enforcement mechanism. <br /> <br />Support legislation requiring the NC Department of Transportation to develop alternative §ubdivision <br />road techniques to preserve trees and limit land disturbance and erosion. <br /> <br />Seek funding for the establishment and implementation of Rural Transportation Planning <br />Organizations throughout the state. <br /> <br />Support legislation to require compensation from state agencies and units of local govemmen{s for lost <br />property taxes when they pumhase mitigation land in other jurisdictions if it results in substantial <br />adverse fiscal impact to the host county. <br /> <br />Support "Smart Growth" legislation that establishes state sponsored growth management programs <br />that are voluntary, and encourages county participation through the use of state incentives, including <br />but not limited to additional growth "tools" for county govemments, additional financing options, and <br />preferential treatment in land use related state grant programs. These programs should take into <br />account diversity of topography, population patterns, eCOnomic conditions, and rural/urban character <br />by providing options, not mandates, for counties. These state programs should have dedicated state <br />funding sources, including planning and technical assistance for county government participants. <br /> <br />Furthermore, the Association will seek legislation to amend the annexation laws to require consultation <br />with county commissioners, including public hearings, on any proposed annexation, and to provide <br />incentives to county and municipal governments that enter into cooperative planning agreements. <br /> <br />GENERAL GOVERNMENT <br /> <br />o <br /> <br />Support legislation to restore application of the "Public Duty Doctrine" to local governments. <br /> <br />Support efforts to encourage the General Assembly, when developing the legislative redistricting plan, <br />to use ex[sting county lines Whenever possible. <br /> <br />Support legislation that continues the current level of state funding for all existing positions in county <br />Soil and Water Conservation offices. <br /> <br />Seek legislation to increase flexibility in the use of fees generated for Emergency 911 Service in order <br />to expand the ability of counties to enhance these servlces. <br /> <br />The North Carolina Association of County Commissioners opposes the restructuring of the electric <br />industry in the State of North Carolina. <br /> <br />However, should restructuring legislation be advanced, the Association advances the following goals: <br /> <br />o County Tax revenues. Support legislation which reforms the system of utility property taxation in <br /> order to prevent any potential or actual loss of county property tax revenues in a deregulated <br /> electricity market. <br />o Effect on low and fixed Income citizens. Support deregulatory legislation that maintains <br /> affordable electrical service for iow and fixed income citizens. <br />o County economic development. Support deregulatory legislation that enables North Carolina's <br /> counties to achieve their economic development goals. <br />o Reliability. Support deregulatory legislation that maintains the reliability of electric service <br /> statewide. <br />o Effect on residential customers.
