BOARD OF COMMISSIONERS <br />Monday, April 19, 1999 <br /> <br />Staff' Use Ouly: <br /> Approved: <br /> <br /> Den/cd: <br /> 'l"ablcd: <br /> <br />Zoning and Subdivision Regulation: Mike Downs and Mike Byrd <br /> <br />Zoning and lot size proposals are OK. <br /> <br />Conclusions: Gaillard Mervin is appealing the decision of the Planning and Zoning <br /> Commission and has submitted this preliminary plat for approval by the <br /> Cabarrus County Board of Commissioners. <br /> <br />The subdivision is residential in nature. It consists of 94 proposed lots and <br />will be an extension of the previously approved Porters Landing - Phases <br />I - IV. <br /> <br />At build-out, this subdivision may add approximately 56 (94 lots x .6) <br />children to the Cabarrus County school system. Please see Exhibits 2, 3, <br />and 4 for information pertaining to the addition of children to the school <br />system. <br /> <br />Staff Recommendation: <br /> <br />There are other subdivisions in the Rocky River/J.N. Fries/Central Cabarrus <br />school district, which already have preliminary plat approval, and must be <br />taken into consideration (See Exhibit 4) when reviewing remaining school <br />capacity. <br /> <br />The applicant has expressed interest in working with the Board of <br />Commissioners to reach an agreement to help advance school capacity. <br /> <br />Planning staff recommends that the preliminary plat for Porters Landing - <br />Phases V and VI subdivision be DENIED until such time that school <br />facilities are adequate to serve the expected number of students generated by <br />this proposed development, unless the Board decides Mr. Mervin's offer is <br />adequate enough to advance school capacity. <br /> <br />This recommendation is based on the fact the school system cannot <br />adequately handle the additional students at this time. <br /> <br />PZC Action: <br /> <br />On Thursday, March 18, 1999, the Cabarrus County Planning and Zoning <br />Commission VOTED TO DENY the preliminary plat for Porters Landing - <br />Phases V and VI subdivision for the following reason: <br /> The proposed development does not meet the adequate public facilities <br /> provision of the Cabarrus County Subdivision Ordinance (Section 66- <br /> 81). Specifically, the Cabarrus County School District does not have <br /> adequate facilities at this time to serve the estimated number of students <br /> who would be generated by the proposed development. <br /> <br /> Page 3 of 3 <br />Porters Landing Phases V and VI <br /> <br /> <br />
