451 <br /> <br />DRAFT <br /> <br />East from Medium Density Residential to Low Density Residential - Special Use <br />with the condition that the double wide mobile home be located on the same spot <br />as a previous mobile home and that a buffer about 50 to 60 feet long of evergreen <br />trees be planted along the boundary line between the Montgomery property and the <br />Medlln property. <br /> <br />Findings of Fact: <br /> <br />(1) Proposal is residential in nature and therefore would be consistent with the <br /> type of development tn the area. <br />(2) Existing natural buffers (woods) will help to decrease visual impact of <br /> mobile home from Highway 73 aa well as the majority of residences adjacent <br /> to the property. <br />(3) Applicant has expressed desire to rent the mobile home so that she may have <br /> somebody nearby £n case of an emergency. <br /> <br />Advisory Homestead Exemption Referendum Resolution <br /> <br /> A summary of exemption valuation and revenue loss numbers for homestead <br />exemption amounts ranging from the current amount of $20,000.00 to $65,000.00 was <br />included in the agenda. Mr. Clifton advised that revenue loss information related <br />to changes in qualifying income levels could not be determined by staff. <br /> <br /> Mr. Hartsell again explained that the referendum would be "advisory' in <br />nature as there is a separate Constitutional provision that deals with exemption <br />provisions. Legislation is now pending in the General Assembly that would allow <br />counties to address this issue. <br /> <br /> There was discussion regarding a potential exemption amount of $35,000.00, <br />concern that the exemption is based on age rather than need, possible confusion <br />by the public if the "advisory" referendum is approved and support of pending <br />legislation to allow counties ~o increase the exemption amount. <br /> <br /> UPON MOTION of Co~missioner Mills, seconded by Commissioner Carpenter and <br />unanimously carried, the goard moved to table the Advisory Homestead Exemption <br />Referendttm Resolution and to advise the local legislative delegation that the <br />Board favors legislative action that would allow counties to make a decision <br />regarding the homestead exemption. <br /> <br />CONSENT AGENDA <br /> <br />Road Petition - Addition of McGoy Street to State Road System <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Mills and <br />unanimously carried, the Board approved the addition of McCoy Street to the State <br />road system. <br /> <br />Road Petition - Abandonment of a Portion of Ed~efield Road from the State Road <br />System <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Mills and <br />unanimously carried, the Board approved the abandorument of a portion (0.06 mile) <br />of Edgefield Road (SR 1190) from the Secondary road system. <br /> <br />Adoption of Ordinance Extendin~ the Residential Solid Waste Franchise Ordinance <br />Through January 31~ 1998 - Second Readln~ <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner Mills and <br />unanimously carried, the Board adopted the following Ordinance on second reading. <br /> <br /> Ordinance No. 1997-20 <br /> ORDINANCE EXTENDING THE <br />RESIDENTIAL SOLID WASTE FRANGHISE ORDINANCE <br /> <br /> WHEREAS, BFI Waste Systems of North America, Inc. holds a franchise <br />to provide residential solid waste collection in the unincorporated <br />areas of Cabarrus County; and <br /> <br /> WHEREAS, negotiations on a new franchise agreement are continuing <br />between BFI Waste Systems of North America, Inc. and Cabarrus County; <br />and <br /> <br /> <br />
