Budget Increase Decrease Budget <br />01-9-19-52-165 17,000.00 32,500.00 49,500.00 <br />Architect Services <br />01-6-17-10-901 8,178,813.95 32,500.00 8,211,313.95 <br /> Fund Balance Appropriated <br /> <br />Proposed cable Television Ordinance and Franchise Agreement with Time Warner <br />Entertainment-advance Newhouse - Second Reading - Public Eear£ng - 6:30 P.M. <br />aa soon %hereafter as parsons may be heard} <br /> <br /> Mr. John Day, Deputy County Manager for Operations, outlined the four <br />changes which were made to the Cable Television Ordinance and Franchise Agreement <br />by Time Warner Cable since the first reading: (1) Maximum distance for a standard <br />(i.e., no additional charge) installation was reduced from 300 feet to 150 feet; <br />{2) The provision requiring Time Warner to produce local programming on the local <br />access channel was removed; (3) The requirement for activation of an emergency <br />alert system within 12 months of the effective date of the franchise agreement <br />was changed to within 12 months of the adoption of emergency alert system rules <br />by the FCC; (4} The Cannon Memorial Library, Concord Branch, was added to the <br />government INET. <br /> <br /> Mr. Bob Melton, Time Warner Cable General Manager, responded to questions <br />from the Board regarding the proposed franchise. He referenced a letter of intent <br />dated February 10, 1998 in which he indicated that local policy will include a <br />standard maximum installation distance of 300 feet and continuation of local <br />programming on the local access channel. The letter which referenced a number <br />of issues discussed during the cable television franchise renewal process is on <br />file in the Office of the County Manager. <br /> <br /> At 7:00 P.M., Chairman Casper opened the public hearing regarding the cable <br />Television Ordinance and Cable Franchise Agreement and asked if anyone wished to <br />address the Board regarding the proposed Ordinance and Agreement. The Public <br />Hearing Notice was published in The Iodependent Tribune and The Charlotte <br />Observer (C~barrus Neighbors) on February 1, 1998. There was no one present to <br />speak to this issue, and Chairman Casper closed the public hearing. <br /> <br /> UPON MOTION of Commissioner Niblock, seconded by Commissioner Carpenter and <br />unanimously carried, the Board adopted on second reading the Cable Television <br />Ordinance for the County of Cabarrus, North Carolina and approved on second <br />reading the Franchise Agreement Between Cabarrus County, North Carolina and Time <br />Warner Entertainment-Advance Newhouse. The Ordinance and Franchise Agreement are <br />as follows. <br /> ORDINANCE NO. 1998-05 <br /> CABLE TELEVISION ORDINANCE <br /> January l, 1998 <br />I. PURPOSE <br /> The County of Cabarrus finds that the development of a cable television <br />system has the potential of having great benefit and impact upon the people of <br />Cabarrus. Because of the complex and rapidly changing technology associated <br />with cable television, the County further finds that the public convenience, <br />safety and general welfare can best be served by establishing regulatory <br />powers which should be vested in the County or such persons as the County <br />shall designate. It is the intent of this Ordinance and subsequent amendments <br />to provide for and specify the means to attain the best possible public <br />interest and public purpose in these matters and any Franchise issued pursuant <br />to this Ordinance shall be deemed to include this finding as an integral part <br />thereof. <br /> Further, it is recognized that Cable Television Systems have the <br />capacity to provide not only entertainment and information services to the <br />County's residents, but can provide a variety of broadband, interactive <br />communications services to institutions and individuals.
