Planning and Zoning Commission Minutes <br />April 16, 1995 <br /> <br />to general commercial and therefore, we have to look at every single use <br />that the general commercial district allows. Staff feels at this time that <br />there are some uses in that general commercial district that would not be <br />compatible. Second, on the first piece of property there is a single- <br />family house and a mobile home. The mobile home is not conforming in <br />the medium density residential district and it would also be <br />nonconforming in any commercial district or residential district. The <br />single-family house is conforming and the business on the triangle piece <br />is nonconforming. If both parcels are rezoned to general commercial the <br />business will be conforming, but the single family will be <br />nonconfomfing. Mr. Lagano said that is something that we would like to <br />stay away from. He said sometime in the future if the property is zoned <br />commercial and the single-family residence removed, then that would <br />solve the nonconfot-irdng use problem. Mr. Lagano said staff could <br />support the rezoning of these two parcels to a commercial zoning, but <br />not just general commercial straight rezoning. The reasons, one is the <br />two parcels have frontage on Highway 49 and in the future as Highway <br />49 is widened these.two parcels would lend themselves to a commercial <br />use as would any other parcels along Highway 49. Second, the adjacent <br />zoning around these two parcels on the western side is general <br />commercial special use. To the north, west, and east there is city zoning <br />district, which is light industrial. To the south it is zoned medium <br />density residential. Just pass the property down Highway 49 is the Elon <br />Chemical Distribution building which is grandfathered as medium <br />density residential. Mr. Lagano said in general the staff feels that this <br />particular area has the potential of becoming a commercial or light <br />industrial node, so it would support some type of rezoning. What staff <br />would like to suggest is not a rem/ting to general commercial, but a <br />rezoning to general commercial special use, where they can identify a <br />few of the trses that they are thinking about in the future. He said that <br />would solve our problem of having to identify or look at every use <br />allowed in the general commercial district. Mr. Lagano said in the staff <br />report, staff said that they would also recommend a rezoning to <br />Office/Light Commercial, which would narrow down the heavy <br />commercial uses that could be used, and staff thought that it would meet <br />the applicant's needs. But, staff found out the applicant wants to <br />continue having a contractor's storage yard on the property. The <br />office/light commercial would not be appropriate b .ecause it does not <br />permit that use, so therefore, you would be looking at the general <br />commercial. However, a special use rezoning would narrow down the <br />uses that they would be allowed to use. In conclusion, staff would <br /> <br /> <br />
