Planning and Zoning Commission Minutes <br />April 16, 1998 <br /> <br />Page 6 <br /> <br />recommend denial of the application or petition for a general commercial <br />straight rezoning, but would support a ,rezoning request to a general <br />commercial special use. <br /> <br />The Chair opened the Public Hearing on Petition C98-06(R ). <br /> <br />Mr. Sam Davis, Attorney representing Angela McDonald/McDonald <br />Construction Company, addressed the Board stating there are two part <br />tax parcels identified on the map. The one on the east is owned by <br />McDonald Construction Company, and the one on the west was recently <br />purchased by Angela McDonald. The parcel on the east has been used <br />for a number of years by McDonald Supply and Feed Company. The <br />other property is used for contractor's storage and McDonald <br />Construction Company. When the zoning was adopted it was originally <br />zoned I-X and at some point and time it was rezoned to medium density <br />residential and made the business nonconforming. Mr. Davis said the <br />reason for requesting this rezoning was to bring their existing business <br />into conformity. He said general commercial is the only zone that <br />permitted them to operate both the retail that they have there now and the <br />contractor's storage yard. Mr. Davis said most of the uses that are <br />permitted in general commercial that are not pemdtted in limited <br />commercial that the Board might have objections to could not'be <br />developed on that piece of property anyway. He said as far as the <br />nonconfomfing residential, that is what's there now and in the long term <br />it is not appropriate for residential development. Mr. Davis said as the <br />widening of Highway 49 occurs and growth occurs the residential will be <br />eliminated. <br /> <br />Mr. Kiefer asked Mr. Davis if the applicants had any problem with the <br />staff changing it to limited industrial? <br /> <br />Mr. Davis said the problem with limited commercial is that it permits the <br />retail, but it does not permit the contractor's storage yard.. <br /> <br />Mr. Hobbs asked since they are grandfathered in, is there a pressing <br />need to change it? <br /> <br />Mr. Davis said they own the land but they cannot expand. He said if it <br />is nonconforming they cannot increase the nonconfomdty. <br /> <br />Mr. Hobbs asked if they plan to expand. <br /> <br /> <br />
