232 <br /> <br />D AFT <br /> <br />be non conforming and any expansion of these uses would be subject <br />to the provisions of Chapter 14 of the Cabarrus County Zoning. <br /> <br />Vesting: Vesting to claim process under current development <br />regulations is hereby established to be sixty (60) days from the <br />effective date of enactment of this Ordinance Amendment. The <br />lando%rner who desires to a vesting of former district's use but does <br />not wish to secure the necessary zoning permit or is unable to do so <br />in the sixty (60) day timeframe, shall submit a site plan within <br />sixty (60) days. All requests shall be subject to the procedures <br />outlined in Chapter 13, Part VI, Section 13-20 of the Zoning <br />Ordinance. <br /> <br />Proposed Chan~es: <br /> <br />I. Revise Chapter 3, Section 3-7, COMMERCIAL DISTRICTS, (2) General <br />Commercial; Uses in the General Commercial Zone to eliminate the <br />following: <br /> <br />Permitted uses <br />Family care home <br />Group care facility <br /> <br />Permitted Based on Standards {PBS) <br /> <br />Duplex <br />Multifamily residential <br />Townhouses <br /> <br />II. Revise Chapter 3, Section 3-8, Table of Permitted Uses, category <br />2., Residential, page 3-22, Table of Permitted Uses - Residential <br />Uses to reflect elimination of the following: l) Duplex <br /> 2) Family Care home <br /> 3) Group care facility <br />7) Multifamtly residential <br />8) Townhouses <br />The revised table~ found on pa~e 3-22~ reflectin~ these changes is <br />attachedI labeled as Exhibit A. <br /> <br />III. Revise Chapter 7 Performance Based Standards (PBS), Section 7-4 <br />Uses Permitted Based on Standards (PBS): <br /> <br />14, Duplex <br />revise list of 'zones permitted based on standards': to eliminate the <br />entry for general commercial. <br /> <br />STANDARDS: add the following - <br />b) Maximum Density. The maximum allowed density for duplexes in the <br />Office/Limited Commercial zoning district shall be six (6) dwelling <br />units per acre. <br /> <br />24. Multifamil¥ residential <br />revise list of 'zones permitted based on standards': to eliminate the <br />entry for general commercial. <br /> <br />STANDARDS: add the following - <br />b) Maximum Density. The maximum allowed density for multifamlly <br />residential units in the Office/Limited Commercial (OF~LC) zoning <br />district shall be six (6) dwelling units per acre. <br /> <br />c) Density Bonus. A density bonus of two (2) dwelling units per acre <br />will be allowed for projects which can successfully demonstrate the <br />concept of a mixed use development as defined in Chapter 2, Rules of <br />Construction and Definitions. This can generally be accomplished <br />through the submission of a site plan and appropriate architectural <br />drawings. <br /> <br />43. Townhouses <br />revise list of "zones permitted based on standards": to eliminate the <br />entry for general commercial. <br /> <br />STANDARDS: add the following - <br />c) Maximum Density. The maximum allowed density for townhouse units <br />in the Office/Limited Commercial zoning district shall be six (6) <br />dwelling units per acre. <br /> <br /> <br />
