4. If the building upon the Demised Premises shall be damaged by fire or other casualty, <br />and such damages are of a minor nature, the same shall be repaired by Cabarrus County directly, <br />or from the proceeds of insurance coverage, as quickly as is reasonably possible; but if said <br />building shall be damaged to such an extent as to render the same unfit for use or occupancy, this <br />Lease shall terminate and the proceeds of insurance coverage shall be paid to Cabarrus County, <br />and Historic Cabarrus shall be relieved from further liability under the Lease. <br /> <br /> 5. Historic Cabarrus shall be responsible for the payment of all bills for water, heating <br />and electrical current, and the occupants of the building shall be responsible for the payment of <br />their own respective telephone bills. <br /> <br /> 6. Historic Cabarrus shall not have the right to assign this Lease without prior approval <br />by the County but shall have the right to sublet any parts of:the Old Cabarrus County Courthouse <br />to such organizations as it may desire subject to the terms of this Lease; provided, however, that <br />Historic Cabarrus and its under tenants shall make no unlawful or offensive use of the premises. <br />Historic Cabarrus hereby warrants that it will not arbitrarily restrict the use of said premises and, <br />subject to its use of the building and the agreements Historic Cabarrus enters into with any <br />sub-lessee, will make the building available for bona fide public uses. <br /> <br /> 7. If Historic Cabarrus shall not be diligent in its solicitation of funds and shall fail to <br />pursue its work in the maintenance and preservation of the Old Cabarrus County Courthouse in <br />an orderly manner for a period of ninety (90) days after written notice of such default by the <br />County or shall violate any other terms of this lease, the County shall have the right to its option <br />to declare this Lease canceled. <br /> <br /> <br />
