Overload flows are not to be <br />included for the purpose of computing velocity of flow. <br /> <br />Waste - means surplus materials resulting from on-site construction and <br />disposed of at other locations. <br /> <br />Watershed - means any designated water supply watershed area <br />regulated with various controls within the jurisdictional boundaries of <br />this Ordinance. <br /> <br />Working Days - means days exclusive of Saturday and Sunday during <br />which weather conditions or soil conditions permit land-disturbing <br />activity to be undertaken. <br /> <br />Section 5 Exclusions <br /> <br />This Ordinance shall not apply to the following land-disturbing activities: <br /> <br />ao <br /> <br />Activities, including the breeding and grazing of livestock, <br />undertaken on agricultural land for the production of plants and <br />animals useful to persons, including, but not limited to: <br /> <br />Forages and sod crops, grains and feed coops, tobacco, <br />cotton, and peanuts. <br />Dairy animals and dairy products. <br />Poultry and poultry, products. <br />Livestock, including beef cattle, sheep, swine, horses, <br />ponies, mules, and goats. <br />Bees and apiary products. <br />Fur producing animals. <br /> <br />Activities undertakin on forestland for the production and <br />harvesting of timber and timber products and conducted in <br />accordance with best management practices set out in Forest <br />Practice Guidelines Related to Water Quality, as adopted by the <br />Department. If land-disturbing activity undertakin on forestland <br />for the production and harvesting of timber and timber products is <br />not conducted in accordance with Forest Practice Guidelines <br />Related to Water Quality, the provisions of this Ordinance shall <br />apply to such activity and any related land-disturbing activity on <br />the tract. <br /> <br />Activities for which a permit is required under the Mining Act of <br />1971, Article 7 of Chapter 74 of the General Statutes. <br /> <br />6 <br /> <br /> <br />
