428 <br /> <br />DR FT <br /> <br /> The Planning and Zoning Commission approved the Petition on October 16; <br />however, Harry Franklin and T. Diane Mowrer, Webster and Frances g. Medlin and <br />Richard Smith appealed that decision. The Notice of Public Hearing was published <br />in THE INDEPENDENT TRIBUNE on November 3 and 14, 1997. <br /> <br /> Mr. Hartsell and the County Clerk affirmed Ms. Celeste Montgomery, <br />Petitioner. <br /> <br /> Ms. Celeste Montgomery, Petitioner, presented photographs of the proposed <br />location of the doublewide mobile home. She stated the mobile home would be <br />placed at the same location as a previous mobile home and the existing driveway <br />to her residence would provide access to the mobile home. Ms. Montgomery reported <br />that the resident of the mobile home will assist with her health care. <br /> <br /> Mr. Har~sell and the County Clerk affirmed the following persons: Mr. Jim <br />Scarbrough, Mr. Richard Smith, Ms. Ginger McClellan, Mrs. Frances Medlin, Mr. <br />Dennis McEachern and Ms. Diane Mowrer. During the hearing, they also affirmed <br />Mr. Jonathan Marshall, Planning Services Director. <br /> <br /> Mr. Jim Scarbrough, Attorney representing a few of the area residents, <br />opposed the special use rezoning due to its impact on property values in the <br />area. He asked those persons who were present in opposition to the rezoning to <br />stand~ Approximately 15 to 20 persons stood in opposition. <br /> <br /> Mr. Richard Smith of 2340 Van Tassel Drive, Concord, opposed the rezoning, <br />stating it would devalue his property and other property in the area. He <br />presented a map showing the location of his home and other residences in the <br />Sleepy Hollow Subdivision and surrounding area. He complained the mobile home <br />would be visible from his residence and questioned the issue of spot zoning. <br /> <br /> Ms. Ginger McClellan of Van Tassel Drive, Concord, opposed the rezoning. <br />She stated she would be able to see the mobile holne from her deck and her <br />property value would decrease. <br /> <br /> Mrs. Frances Medlin, resident of Highway 73 East and adjoining property <br />owner, spoke in opposition to the rezoning. She outlined plans for the future <br />development of her 25 acres of property and stated the placement of the mobile <br />home would decrease her property value. <br /> <br /> Mr. Dennis McEachern, resident of Sleepy Hollow, stated he planned to <br />develop approximately 28 acres around his home at some time in the future. He <br />complained the mobile home would decrease the value of his property. <br /> <br /> Ms. Diane Mowrer, resident of Highway 73 East, Concord, opposed the <br />rezoning, stating the area is an established community of site built homes. She <br />submitted approximately fifty (50) written statements from residents of the area. <br />The Statement read as follows: <br /> <br />Statement of Objection to Rezone PIN 5641-50-3751 from (MDR to LDR- <br />SU) Allowing the Addition of a Mobile Home for Rental Income within <br />the Highway 73 East Corridor: <br /> <br />I, the undersigned, live along NC Highway 73 East or directly within <br />the Highway 73 East Corridor and strongly object to the rezoning of <br />PIN 5641-50-3751 owned by Celeste Barnhardt Montgomery. I request <br />the Cabarrus County Planning and Zoning Commission to deny this <br />rezoning petition. The addition of any mobile homes for rental <br />property and transient residency will greatly decrease the property <br />values and quality of life in this section of the Highway 73 East <br />Corridor. This highway is the major radial road leading into the <br />City of Concord from the eastern part of Cabarrus County. <br /> <br /> Commissioner Carpenter questioned the ownership of an igloo in the area. <br />Mr. McEachern advised that the igloo is located on his property and is a business <br />project. <br /> <br /> Mr. Marshall reported a site plal~ showimg the specific location of the <br />mobile home had not been submitted; however, he stated Ms. Montgomery had <br />testified the unit would be placed at the same location as a previous mobile <br /> <br /> <br />
