RAIL CORRIDOR STUDY RESOLUTION <br /> <br /> ~HEREAS, the North Carolina Department of Transportation has <br />plans to eliminate redundant aNd/or hlEh hazard at-grade railroad <br />crossings statewide in order to promote more safe and efficient <br />traffic operations; and <br /> <br /> I4HEREAS, the North Carolina Department of Transportation and <br />the County has agreed that comprehensive traffic study and railroad <br />crossing analysis would benefit the traffic operations within the <br />County; and <br /> <br /> I~HEREAS, the North Carolina Department of Transportation has <br />agreed to prepare the study, at no expense to the County or the <br />municipalities; and <br /> <br /> WHEREAS, if the study recommends the consolidation of one or <br />more crossings, the municipalities agree to close a crossing and/or <br />crossinEs, Furthermore, NCDOT agrees to assist the municipalities <br />in developing mitigation projects where applicable with the <br />crossings recommended for closure. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that said project in <br />Cabarrus/Rowan County, is hereby formally approved by the <br />Commissioners of the County of Cabarrus and that the Chairman and <br />Clerk of this County are hereby empowered to sign and execute the <br />Agreement with the North Csrolina Department of Transportation. <br /> <br />HOME Investment Partnerships ProGram - Proposed Participation in the HOME <br />Consortium - Mr. Jonathan Marshall <br /> <br /> Mr. Marshall and Mr. Steve Osborne of the City of Concord reviewed the <br />proposal for Cabarrus County to Join with Iredell County, Rowan County, the City <br />of Concord and other area municipalities to form a consortium to be eligible to <br />receive HOME funding directly from the Department of Housfn~ and Urban <br />Development. Cabarrus County may agree to Join without a commitment to provide <br />any matching funds. However, if the Coumty chooses to participate in seeking HOME <br />funds, a 25 percent local contribution will be required. <br /> <br /> UPON MOTION of Commissioner Mills, seconded by Chairman Barnhart and <br />unanimously carried, the Board by resolution approved Cabarrus County's <br />participation in the HO~ Consortium with the counties of Iredell and Rowan, the <br />City of Concord and other area municipalities. The City of Concord will serve <br />as the I~ad Entity for the Consortium. <br /> <br />ZoninA Ordinance/Zo~in~ Atlas Amendments - Proposed Airport-Airspace Overlay Zone <br /> Public hearinG - ?:00 P.M. <br /> <br /> Mr. Marshall presented Petitions 96-02(T) and 96-02, 'Airport-Airspace <br />Overlay Zone.' Petition 96-02(T) amends Chapter 4 of the Csbarrus County Zontn~ <br />Ordinance by adding the text of the Overlay Zone which is intended to protect the <br />airspace of the Concord Regional Airport. Petition 96-02 amends the Zoning Atlas <br />by placing the overlay zone on the area surrounding the Concord Regional Airport <br />that falls within the zoning jurisdiction of Cabarrus County. <br /> <br /> At 7:08 P.M., Chairman Barnhart opened the public hearing for Petitions 96- <br />02(T) and 96-02 and asked if anyone were present who wished to speak either for <br />or against the Petitions. <br /> <br /> Mr. Dwayne Jordan, Assistant Aviation Director with the City of Concord, <br />spoke in support of Petitions 96-02(T) and 96-02. He stated that approval of the <br />petitions would protect the safety of persons usin§ the airport as well as <br />surroundinG property owners. <br /> <br /> Mr. Hoyle Holland, property owner, asked that the Board delay the public <br />hearing, stating that all property owners in the area were not notified. Further, <br />Mr. Holland objected to the proposed zoning regulations, stating that the <br />regulations were not needed as the Federal Aviation Administration has the <br />authority to control structures in the area surroundinG the airport. <br /> <br /> <br />
