87 <br /> <br /> Ms. Marllyn Bernhardt, resident of the Farm Hill Subdivision, questioned <br />the purpose of the proposed amendments. She complained of airplanes flying over <br />her home and expressed concern about the safety of the Farm Hill residents. <br /> <br /> Mr. Marshall explained that the proposed amendments regulated the height <br />of structures that can be constructed in the airport overlay zone. <br /> <br /> Mr. Gary Versa of W. K. Dickson reviewed the proposed amendments and <br />outlined the review process by the Federal Aviation Administration (FAA). He <br />explained that the FAA can determine if a proposed structure is a hazard or an <br />obstruction but has no authority to prohibit the construction of the structure. <br />Approval of the proposed amendments will provide local authority to regulate the <br />construction of these £acilities. According to Hr. Varga, the proposed <br />regulations are no more restrictive than the FAA regulations. <br /> <br /> There was no one else present who wished to address the Board, and Chairman <br />Bar,hart closed the public hearing at 7:25 P.M. <br /> <br /> UPON NOTION of Commissioner Fennel, seconded by Chairman Barnhart and <br />unanimously carried, the Board approved Petitions 96-02 and 96-02(T). Petition <br />96-02 amended the Zoning Atlas by placing the airport overlay zone on the area <br />surrounding the Concord Regional Airport that falls within the County's zoning <br />jurisdiction. The Zoning Atlas, with the approved airport overlay zone, is on <br />file in the Office of the Zoning Administrator and hereby included by reference <br />as a part of the minutes. Petition 96-02(T) amended Chapter 4 of the Cabarrus <br />County Zoning Ordinance to include the following: <br /> <br /> PETITION 96-02 (T) <br /> PART V. AIRPORT ~ AIRSPACE OVERLAY ZONE <br /> Section 4-24. Intention. <br /> This district is established to prevent the creation or <br /> establishment of obstructions or land uses that are hazardous to air <br /> navigation, thereby protecting the lives and property of the users <br /> of the Concord Regional Airport, the property and occupants of land <br /> in the vicinity, and the involved public investment. This district <br /> is further intended to provide for the safe landing, take-off, and <br />· maneuvering of aircraft in accordance with Federal Aviation <br /> Administration (FAA) standards· <br /> <br />Section 4-25. Definitions. - Except as specifically defined herein, <br />all words used in these regulations have their customary dictionary <br />definitions. For the purpose of these regulations only, certain <br />words or terms are defined as follows and are not applicable to <br />other sections of the Zoning Ordinance. <br /> <br />Airport - The Concord Regional Airport. <br /> <br />Airport Elevation - The highest point of an airport's usable landing <br />area measured in feet from mean sea level, or for the purpose of <br />these regulations, 690 feet above mean sea level for the Concord <br />Regional Airport. <br /> <br />Airport Hazard - Any structure or object of natural §rowth located <br />on or in the vicinity of a public airport, which obstructs the <br />airspace required for the flight of aircraft in landing or takeoff <br />at such airport or is otherwise hazardous to such landing or takeoff <br />of aircraft. <br /> <br />Approach, Transitional, Horizontal and Conical Zones - These zones <br />apply to the area under the approach, transitional, horizontal and <br />conical surfaces defined in Federal Aviation Regulations (FAR) Part <br />77. <br /> <br />Height - For the purpose of determining the height limits in all <br />zones set forth in these regulations and shown on the zoning map, <br />the datum shall be mean sea level elevation, unless otherwise <br />specified. <br /> <br />Nonconforming Use - Any preexisting structure, object of natural <br />growth, or use of land which is inconsistent with the provisions of <br />these regulations, or any amendment thereto. <br /> <br /> <br />
