When we went to pick up the permit we were notified by the zoning that <br />the 100 year flood plain was under the change and we could not build on that lot until <br />it was established or finalized. We could not wait for this to take place as it takes <br />months and we told the customers that we would let them have lot 27 at the same price <br />and put their house on it, which we did. <br /> <br />The new flood level is at 563' which is 7' higher than the old one, plus Cabarrus <br />requires 2' above flood plain for finished floor which makes this lot useless as far as <br />constructing a home on it. We have had other offers to purchase this lot but when told <br />the change in the flood plain they don't want it. <br /> <br />At the time of recording this platt we could have built a house on it but not anymore. <br /> <br />I have enclosed a copy of the voided contract and the Heidtke's check ,a copy of the <br />letter Jonathan Marshall with the Cabarrus Planning wrote, and 7 copies of the Petition <br />for Blackjack Oak Court. <br /> <br />Best regards, <br /> <br />C M Prince <br /> <br /> <br />
