He said <br />there was a maximum of 25, what do they have in mind on that? <br /> <br />Mr. Marshall said we changed our customized development <br />standards since the ordinance was originally adopted. The 25 was <br />a previous version that would basically be pods of the <br />development. They could ultimately develop these same 162, they <br />would just have to divide 25 lots and have open space, 25 lots open <br />space in between. Again, that became a design issue that we <br />started looking at proposed developments that really did not work. <br />That was eliminated with this amendment. <br /> <br />Mr. Hill said on the berming requirements, 200 feet setback from <br />the road, being that this is flat, is there some kind of foliage or <br />earthen berms standards there? <br /> <br />Mr. Marshall said no, but they setback that 200 foot distance. It is <br />only if they setback less than 200 feet, then they would have to <br />meet that level three buffer yard, which could be berms, fencing, or <br />vegetation. By setting back 200 feet or greater, they do not have to <br />meet that requirement. <br /> <br />The Chair said the staff did not make a recommendation on this. <br /> <br />Mr. Marshall said that was primarily because it was an open <br />question about Mike Downs interpretation about the level three <br />buffer yard. They meet all of the standards of the zoning <br />ordinance, so the staff recommends approval. If the Board was to <br />disapprove this then we will need finding of facts to indicate why <br />they, the Board, is disapproving it. <br /> <br />There being no further discussion, the Chair MOTIONED to <br />approve preliminary subdivision plat for Hawick Commons, <br />seconded by Mr. Hobbs. <br /> <br />Mr. Koch, Attorney for the Planning and Zoning Commission <br />asked the Chair if her motion include the question about the <br />waiver of the level three buffer yard? <br /> <br /> <br />
