The Engineer shall not be responsible for the acts or omissions <br />of the Contractor, any Sub-contractor, or any of the Contractor's <br />or Sub-contractor's agents or employees, or any other persons <br />performing any of the work under the construction contract. <br /> <br />For these services, the Engineer will be paid by the Owner at the <br />hourly rates indicated in Part IV, Number 9. <br /> <br />Part IV - Miscellaneous Engineerinq Services <br /> <br />In addition to the foregoing services, other special services may <br />be performed when requested by the owner: <br /> <br />The testing of materials such as concrete, reinforcing steel, <br />soil testing, flow gauging or sewage analyses as these are <br />services rendered by commercial laboratories, or <br /> <br />The establishing of property corners, topographical surveys, <br />rights-of-way or property surveys, since these services <br />should be rendered by a duly authorized local land surveyor, <br />or <br /> <br />3. The preparation of Operation and Maintenance Manuals for any <br /> necessary pumping facilities. <br /> <br />The Engineer will advise the Owner of the need for any of <br />these services and assist the Owner in obtaining these <br />services. Billing to the Owner by the Engineer for professional <br />services of consultants will be the cost of these consultants <br />to the Engineer multiplied by the factor of 1.15. <br /> <br />Necessary filing of maps for water rights, special documents, <br />court work for water adjudications, litigation or other <br />reasons shall be done by the Engineer if requested by the <br />Owner. Payment for these shall be based on direct personnel <br />expenses plus direct reimbursable expenses at cost. <br /> <br />o <br /> <br />For services in preparing documents and drawings for <br />alternate bids requested by the Owner for work which is not <br />executed, or <br /> <br />For redesign done by the Engineer at the request of the Owner <br />after receiving the approval of preliminary plans, the <br />Engineer will be paid a fee based on the hourly rates as shown <br />in Number 9. <br /> <br />For services during readvertisement for bids for <br />construction, the Engineer will receive reimbursement based <br />on the rates as shown in Number 9. <br /> <br /> <br />
