Task 4.7 - Cultural Resources

Rule .1622(7) states that a new MSWLF unit shall not damage or destroy an archaeological or
historical property. The Depmtment of Cultural Resources shall determine archeological or
historical significance. CDM will send a letter to the Department along with a site map and
request a review of the proposed sites for impacts to archaeological or historical sites. If the
Department finds that there will be no impacts, no additional work will be needed.

It is possible that the Department may require a site-specific survey. If so, CDM will solicit
proposals from at least two qualified firms to complete the work. CDM will review the
proposals with County staff who will select the preferred proposal. An allocation has been
made in Section 4 of this Amendment to cover the costs of retaining an
archaeological/historical subconsultant. The actual cost will be passed through to the County
with no additional markup. The cost will not exceed the allowance without prior written
approval by the County.

Task 4.8 - State Nature and Historic Preserve

Rule .1622(8) states that a new MSWLF unit shall not have an adverse impact on any lands
included in the State Nature and Historic Preserve. CDM will contact the appropriate agency
responsible for overseeing protection of lands in the State Nature and Historic Pxeserve to
determine if the proposed sites will have any adverse impacts. The results will be included in
the Site Study.

Task 4.9 - Water Supply Watersheds

Rule .1622(9) states that a new MSWLF unit shall not be located within the critical area of a
water supply watershed or in the water shed for a stream segment classified as WS-1, in
accordance with the rules codified at 15A NCAC 2B .0200. CDM will contact the North
Carolina Division of Environmental Management, Water Quality Section to determine the
proximity of the proposed sites to any of the above-referenced restricted watershed areas.

Task 4.10 - Endangered and Threatened Species

Rule .1622(10) states that a new MSWLF unit shall not jeopardize the continued existence of
endangered or threatened species or result in the destruction or adverse modification of a
critical habitat, protected under the Federal Endangered Species Act of 1973. CDM will
contact both the North Carolina Natural Heritage Program and the U.S. Fish and Wildlife
Service to determine what, if any, endangered or threatened species might be impacted by this
project. If these agencies find that there will be no impacts, no additional work will be
needed. It is possible, however, that one or both of these agencies may require a site-specific
endangered/threatened species survey. If so, CDM will solicit proposals from at least two
qualified firms to complete the work. CDM will review the proposals with County staff who
will select the preferred proposal. An allocation has been made in Section 4 of this
Amendment to cover the cost of retaining an endangered/threatened species subconsultant.

n:XcabarmsMmendT.cab
