AMENDMENT No. 3 TO THE AGREEMENT <br /> BETWEEN <br /> OWNER AND ENGINEER <br /> FOR <br />PROFESSIONAL SERVICES RELATED TO THE <br />CABARRUS COUNTY SOLID WASTE PROGRAM <br /> <br />FURTHER DESCRIPTION OF BASIC SERVICES, DUTIES OF OWNER, <br /> METHOD OF PAYMENT, AND RELATED SERVICES <br /> <br />This AMENDMENT tO THE AGREEMENT made as of ., 1993 is hereby <br />included as an addition to and ~ncorporated as part of the AGREEMENT FOR ENGINEERING <br />SERVICES made on February 4, 1991, between Cabarrus County, North Carolina (OWNER or <br />COUNTY) AND Camp Dresser & McKee (ENGINEER or CDM') for study and report <br />professional services. <br /> <br />The Basic Services of ENGINEER as described in Section 1 of said Agreement are <br />amended and supplemented as follows: <br /> <br />On October 9, 1993, the Subtitle "D" regulations become effective. It is imperative hhat areas of <br />the Cabarms County landfill that have stopped receiving waste be formally closed out before the <br />Subtitle D regulatiens become effective. It is the intent of this contract amendment to prepare <br />closure plans for the "old fill area" and the recently completed vertical expansion areas of the <br />Cabarrus County landfill. <br /> <br />Recent guidance from the State of North Carolina classifies MSWLF units into three categories, <br />depending on when the facility stopped (or will stop) accepting wastes. Cabarms County's <br />existing landfill has units that fall under each of the three categories. These units are the "old fill <br />area" (about 40 acres), the vertical expansion area (about 25 acres), and the existing fill area <br />(about 20 acres). The "old fill area" falls into Category 1 because it did not receive any waste <br />after October 9, 1991. The vertical expansion area received waste after October 9, 1991, but has <br />since stopped receiving waste. It, therefore, will fall into Category 2. The current ~l area will <br />fall under Category 3 since it will receive waste after October 9, 1993. This amendment is <br />intended to address the closure requkements for only the "old fill area" and the vertical expansion <br />area Development of a closure plan for the existing fill area will be covered under a separate <br />amendment. <br /> <br />PRELIMINARY WORK <br /> <br />Prior to beginning work on closure plans for either the "old fall area" or the vertical expansion <br />area, CDM will complete the following tasks to verify that the approach outlined in this <br />amendment meets the Solid Waste Section's approval. <br /> <br />n:~abarmsXam end3-1 .cab <br /> <br />Page 1 of 7 <br /> <br /> <br />
