Planning and Zoning Commission Minutes <br />September 16, 1993 <br /> <br />Paqe 5 <br /> <br />Mr. Jonathan B. Marshall, Staff Member, presented <br />Petition 93-08 and the staff analysis to the Board <br />stating that this property adjoins Kannapolis' <br />jurisdiction. It was reviewed by their planning staff, <br />and they had no objection to the rezoning of this <br />property. If this property is approved for rezoning, it <br />would be important that there be some consideration of <br />administrative rezoning. Mr. Marshall said should this <br />be rezoned R-15, that would leave a strip of I-1 zoning <br />and it should also be considered for an administrative <br />rezoning. Mr. Marshall said the I-1 zoning served to be <br />incorrect to begin with. Rainbow Drive is a residential <br />area. Staff recommends that this petition be approved. <br /> <br />Mr. Amos asked what zones are considered medium density? <br /> <br />Mr. Marshall said he would consider R-9, R-15, R-8 zones <br />are medium density. <br /> <br />The Chair opened the public hearing on Petition 93-08 asking if <br />anyone would like to speak for or against this petition. <br /> <br />Ms. Ruth Fesperman, Petitioner, addressed the Board <br />stating they would appreciate it if the board would help <br />them help their children have the land. <br /> <br />The Chair asked to hear a little more about proposals to <br />do administrative rezoning. <br /> <br />Mr. Newton said as the staff looked at that piece of <br />property, it became quite apparent that the zoning that <br />is on that parcel is not correct. Not only is that <br />parcel not correct, but a couple of others. If the board <br />goes through and recommends rezoning, he said it should <br />be followed up with an administrative rezoning in which <br />we notify those property owners who have the I-1 zoning. <br />The administrative way is one option to have property <br />rezoned. Either this board or the staff would bring it <br />back. You would then forward that on to the County <br />Commissioners following the rezoning of this. Should you <br />recommend denial, and it is denied, then you change the <br />piece to the south which is I-l, then we have created a <br />problem with that parcel. Currently these are parcels <br />that have homes on them. Under our limitations on <br />nonconforming uses the homes are not being allowed to be <br /> <br /> <br />
