is saying is that the only contact they have had was a letter from
the planning staff, and he is not necessarily saying he is against
it, he would just like to have some additional information so he
can state his viewpoint.

The Chair asked Mr. Downs if there are requirements that would
prohibit someone with auto repair garages from working on heavy
trucks and do we have any requirements about time of operation for
these kind of businesses?

Mr. Downs said he think that would be a reasonable condition to put
on the zoning.

Mr. Newton said as a special use you can have conditions including
that it can only be for auto repair and truck repair. But these
conditions would have to be agreed upon by the applicant when it
goes in front of the Board of Commissioners.

Time of operations, Mr. Downs said if you give him reasonable hours
to operate, it would be sufficient. But the applicant would have
to agree with it. He said he thinks there may be some leeway if
there was an emergency and he had to work on someone's car.

Mr. Caldwell asked how would the board address the traffic issue?

Mr. Newton, said NCDOT is planning to put a traffic light at the
intersection of Eva, Rock Hill Church and Poplar Tent Road. It is
in their plan to have one in this fiscal year.

Mr. Larry Hartsell also addressed the Board concerning this
petition.

Mr. Wickens said he would like to apologize to the citizens there
that he did not get in touch with them sooner. It was only through
the graces of Mr. Marshall through the cooperation of his office
that he was able to get the application in on time.

The Chair asked Mr. Wickens would he agree to a condition to limit
his auto repair to auto repair and pickup trucks, rather than 18
wheelers?

Mr. Wickens said yes. He said he would also like to amend his
application to show 20 feet coming back off the right-of-way to be
a natural vegetative buffer rather than the fence.

Mr. Newton said that can be done with a note on the plan and it
would be amended before it goes to the County Commissioners per the
board's request.

The Chair stated to Mr. Wickens that the board is recommending 30
feet.

Mr. Wickens said he spoke to the tenant in the house, and he was
concerned about what his plans were about developing the property.
