STATE OF NORTH CAROLINA <br />COUNTY OF WAKE <br /> <br />ENERGY DIVISION <br />NORTH CAROLINA DEPARTMENT <br />OF ECONOMIC AND COMMUNITY <br />DEVELOPMENT <br /> <br />WEATHERIZATION ASSISTANCE PROGRAM <br />FOR LOW-INCOME PERSONS (ANNUAL CONTRACT) <br /> <br />CONTRACT NUMBER 92-1441-50 <br /> <br />PART I <br /> <br /> This AGI{EEMENT made this day of , 19 , by <br />and between the Energy Division, North Carolina Department of Economic and <br />Community Development (hereinafter referred to as the "Grantee") and <br />Cabarrus County Department of Aging , (hereinafter referred to as <br />"Contractor"). <br /> <br /> WHEREAS, Part A, Title IV of the National Energy Conservation Policy Act, <br />(NECPA) Public Law 95-619 provides for a Weatherization Assistance Program to <br />assist in achieving a prescribed level of energy conservation materials in the <br />homes of low-income persons; and <br /> <br /> WHEREAS, The Energy Division, North Carolina Department of Economic and <br />Community Development, has been designated as the agency of the State of North <br />Carolina responsible for administering all federal funds related to the <br />Weatherization Assistance Program; and <br /> <br /> WHEREAS, the Energy Division, North Carolina Department of Economic and <br />Community Development desires the assistance of local community organizations <br />within the State of North Carolina in implementing the Weatherization <br />Assistance Program for low-income persons in North Carolina; and <br /> <br /> WHEREAS, the parties hereto desire to reduce the terms of this agreement to <br />writing; <br /> <br /> NOW THEREFORE, in consideration for the promises exchanged between both <br />parties, the Grantee and the Contractor do mutually agree as follows: <br /> <br /> Section 1: Purpose of Agreement. The purpose of this agreement is to <br />provide for the undertaking of a Weatherization Assistance Program (hereinafter <br />referred to as the Program) for low-income persons particularly the elderly and <br />handicapped persons in North Carolina by the Contractor and to state the terms, <br />conditions, and mutual undertakings of the parties as to the manner in which <br />the Program will be undertaken and completed; and to provide for the <br />undertaking of a Training and Technical Program in an effort to improve the <br />efficiency and quality of services provided to low-income elderly and <br />handicapped Weatherization recipients. <br /> <br /> Section 2: Scope of ProRram. The Contractor shall develop and complete <br />the Program as described in Part III, which is incorporated into this contract <br />as if written word for word herein, filed with and approved by the Grantee in <br />accordance with the terms and conditions of this contract. <br /> <br />-1- <br /> <br /> <br />
