Planning and Zouing Commission Minutes
March 20, 1991 Page

Highway 49 for development purposes. They saw potential
in this property, so they are trying to maximize that
potential while at the same time minimizing the impact
that that development would have on the snrronnding
proper~y. 14r. Speas stated that Cabarrus County would
have more control over egress/ingress if it were a
special use other than what it is now where it is just a
general and permitted use. ~r. Speas stated that the
Amiri's would like for the Commission to recommend to the
Couuty Commissioners to approve this rezoning.

14r. $hultz stated to Mr. Speas that he is confused about
his reference to this rezoning being able ~o put the
county in a better position to control egress and ingress
as re~ard to the thoroughfare plan.

~r. Speas stated that the thoroughfare plan puts certain
conditions on the property. But what Mr. & Mrs. Amiri
are proposing by this particular type of rezoning is
simply to make it even more subject to tbe Board's
control over the egress/ingress because their site plans
have to be approved.

Mr. Shul~z stated that the Thoroughfare Overlay Plan is
rather adequate in tha~ respect.

Mr. Olio-Mills asked Mr. Newton if that was correct.

Mr. New,on stated that there would be no difference
whether it would go through this process or developed
under the ARR zoning. The site plan would be reviewed
under either zone.

Mr. Hartgen ask'ed what would be the conditions of the
Thoroughfare Overlay Zone ~hat would relate to this
property.

Mr. Nawtou stated that the Thoroughfare Overlay Zone
restricts the number of curb cuts, increases the setback
and requires some landscaping.

Mr. Rick Starnes, Resident, stated to the Commission that
he opposed this rezoning because of the traffic on
Highway 49.

Mr. Robert Young, Resident, stated to the Commission the
concern he has is the traffic and he is opposed to this
rezoning.

Mr. Leonard Ail~f, Resident, stated to the Commission
