Nevertheless, the Agency may <br /> also receive reimbursement from the United States <br /> Department <br />of Agriculture (USDA funds) through the North Carolina <br />Division of Aging and the Council, as specified in paragraph <br />4(e). It is understood and agreed, however, that the Council <br />receives monies to fund this Project from the North Carolina <br />Division of Aging, and that Council's obligation to pay the <br />Agency is conditioned upon receipt of such funds. Payments, <br />continuation, renewal, or extensions are subject to the <br />availability of funds for the purposes set forth in this <br />agreement. Should any service(s) funded under this contract <br />receive increased funding (federal and/or state funds) during <br />the contract period, the Agency shall be given the right of <br />firs% refusal to provide the service(s) at the current <br />contracted reimbursement rate. <br /> <br />(a) ~eimbursement to be Based on Performance. Payments shall <br /> be made to the Agency by the Council based .on the <br /> Agency's performance in providing the services described <br /> in paragraph 2. Within five working days following the <br /> end of each calendar month of the contract period, the <br /> Agency shall submit to the Council a report showing the <br /> number of service units provided for each service funded <br /> under this'contract. <br /> <br /> Service units reported to the Council must be documented <br /> by the Agency so that the following information can be <br /> verified: 1) service units are provided to an eligible <br /> individual, 2) service units are provided in full <br /> compliance with the North Carolina Division of Aging <br /> Service Standards, and 3) service units are counted <br /> according to the a~propriate service unit definitions <br /> which are included in the Service Standards referenced <br /> in paragraph 2. The Agency shall give priority for <br /> services to those older persons with the greatest <br /> economic or social needs, with particular attention to <br /> low income minority individuals. <br /> <br /> Subject to the Council's right to verify the accuracy of <br /> the Agency's service unit report and the satisfactory <br /> performance of the work evidenced thereby, the Council <br /> will make payments to the Agency. The amount of each <br /> monthly payment shall be calculated by multiplying the <br /> number of service units provided by the "AAA Unit Rate" <br /> shown in paragraph 2. The budgets for services in this <br /> set forth in Schedule <br /> Agreement <br /> are <br /> A. <br /> <br />(b) Comparison of the Budqeted A;~ Vp~t Co~ ~ate to the <br /> ~otual Cost. The Agency will also be required to submit <br /> a report of actual cumulative expenditures and unit <br /> costs, in a form approved by the Council, as and when <br /> requested by the Council. The Agency's cumulative <br /> expenditures must be submitted within thirty (30) days <br /> following the end of the particular accounting period, <br /> and it must document the Agency's accrued expenses and <br /> <br /> <br />
