4. Payment of funds by the Council as specified in this <br /> agreement is dependent upon and subject to the Council's <br /> receipt of grant funds allocated and appropriated for <br /> this purpose from the N.C. Department of Human Resources, <br /> and should this grant be cancelled by the State for any <br /> reason, the Council shall have no liability to the <br /> County. <br /> <br />5. The County agrees to name Aubrey Attkisson as their <br /> official project director for all matters pertaining to <br /> this agreement. <br /> <br />6. The County agrees to submit in writing to the Council any <br /> request for changes in the aforesaid equipment or budget <br /> therefore, and to receive the approval of the Council <br /> prior to implementing any such changes. <br /> <br />7. Title to the aforesaid equipment, upon delivery and <br /> acceptance thereof, shall be vested in the County, and <br /> all warranties shall similarly become vested to the <br /> County. Any agreements for the servicing of said <br /> equipment shall be made directly between the County and <br /> the vendor. <br /> <br />8. The County to maintain and administer, in <br /> agrees <br /> accordance with sound business practice, a program for <br /> the maintenance, repair, protection, preservation, <br /> control of, and accountability for the equipment so as to <br /> assure its full availability and usefulness for its <br /> intended function. <br /> <br />9. The County agrees to affix a unique identification number <br /> (that is permanently attached for inventory purposes) one <br /> each item of the aforesaid equipment. Within thirty (30) <br /> days following the installation and acceptance of the <br /> equipment, the County shall submit to the Council a <br /> document verifying the identification number, location, <br /> model number~ serial number (if applicable) and condition <br /> of all equipment purchased under this agreement. <br /> <br />10. The County agrees to ensure that all persons who use any <br /> medical equipment purchased under this contract shall <br /> receive any special training required for proper <br /> operation or utilization of said equipment. <br /> <br />11. The County agrees that it will not dispose of, or <br /> transfer title to, and equipment obtained under this <br /> agreement without the prior written approval of the <br /> Council. <br /> <br />12. The County agrees to provide continuing service and <br /> maintain all equipment procured under this agreement in <br /> satisfactory working order. <br /> <br /> Page 2 of 4 <br /> <br /> <br />
