Applicant: Dogwood Partnerst Mast Enterprises~ Inc. <br /> Request: Rezon.ing of Propert~ from R-40 & I-2 to <br /> I-1 <br /> <br /> This was a request to the Cabarrus County Planning and <br /> Zoning Commission from Dogwood Partners and MaSt <br /> Enterprises, Inc. to have their property between Trinity <br /> Church Road and N.C. 73 West, in Township 4 rezoned to <br /> develop an industrial park. <br /> <br /> Staff Member, Jonathan Marshall, presented the Staff <br /> Analysis. <br /> <br /> Mr. Amos asked Mr. Marshall was the Northwestern <br /> Plan <br /> included in this area. <br /> <br /> Mr. Marshall stated yes, the area was recommended for <br /> light industrial use. The approximate route of the <br /> westside bypass would be to the northwest of this <br /> property and connecting with Crisco Road. The plan <br /> indicated both commercial and light industrial uses from <br /> the interchange to the westside bypass. <br /> <br /> Mr. Hartgen asked Mr. Marshall if there had been a draft <br /> plan prepared on how the site would be used? <br /> <br /> Mr. Marshall stated yes there has been, but it has not <br /> been presented to the Board because it would not be <br /> something that could be he].d to this rezoning since it is <br /> a straight request from the existing zoning to I-1. <br /> <br /> Mr. Smith asked would it be possible to put any kind of <br /> restrictions on the rezoning having any kind of <br /> litigation in the work. Mr. Smith stated he was <br /> referring to the watershed regulations. <br /> <br /> Mr. Newton, Planning and Zoning Director, addressed Mr. <br /> Smith's question stating under the current proposal, in <br /> the way the State is classifying Coddle Creek, it would <br /> involve this area as part of its overall watershed. If <br /> the cities of Kannapolis, Concord and Cabarrus County are <br /> successful in what we are working on, this area would no <br /> longer be in the watershed area. Even if that doesn't <br /> happen, the area would be within the watershed. However, <br /> up to 10 percent of each jurisdictions land area can be <br /> diverted to industrial activity in which of that <br /> percent, 70 percent can be developed on. The key <br /> question as to what the Board can do with it tonight is <br /> that it is a straight rezoning. The Board cannot impose <br /> any conditions on this request. <br /> <br /> <br />
