The <br /> strip shall be reviewed and approved at the preliminary <br /> specific <br /> screening <br /> plat review. <br /> <br />SECTION 4.12 MONUMENTS <br /> <br />Unless otherwise specified ..by this ordinance, the standards of practice for ]and <br />surveying as adopted by tile North Carolina State Board of Registration for <br />Professional Engineers and Land Surveyors, under provisions of North Care{ina <br />General Statute Chaplet 39, Article 5A shall apply. <br /> <br />SECTION 4.13 CONSTRUCTION PROCEDURES <br /> <br />A. No construction or installation of improvements shall commence in a <br /> proposed subdivision until the preliminary pla! has been approved, and ail <br /> plans and specifications for roads, utilities and sedimentation and erosion <br /> control have been approved by the appropriate suthorities. <br /> <br />B. During the construction phase the proposed road when adjoining an <br /> existing paved road, shall have a ~-ravelway of a! least one hundred (100) <br /> feet in length, eighteen (IS) in width, wilh a gravel base of at least six <br /> (6) inches, to help eliminate excessive mud and other such materials from <br /> being carried onto the paved road. <br /> <br />C. No building or other permits shall be issued for the erection of a <br /> structure on any lot not of record at the time of adoption of this <br /> Ordinance or created in compliance with this ordinance until <br /> requirements of applicable Slate and local laws bare been met. <br /> <br /> SECTION 4.14 GUARANTEE OF IMPROVEMENTS <br /> <br /> Tile Planning and Zoning Commission in its discretion may waive ~he requirement <br /> that the subdivider complete and dedicate all public improvements prior to the <br /> signing of the final plat, and as an alternative, the subdivider shall guaranlee <br /> the installation of said improveme~lts by one of the following requirements: <br /> <br /> A. Performance Bond - shall be from a company authorized to do business ill <br /> North Carolina. <br /> <br /> B. Letter of Credit - an irrevocable letter of credit shall be from a <br /> recognized financial institutional in North Carolina. <br /> <br /> C. Escrow - cash or other instrument readily convertible inlo cash at face <br /> value in escrow with a recognized financial institution in Norlh Carolina. <br /> <br />All of the aforementioned methods of guarantees shall be of sufficient amount to <br />cover the entire cost plus 25% of completing all required improvements as <br />certified by an engineer designated by the Cabarrus County Planning and Zoning <br />Department; and shall be made payable and/or released in full, free and clear <br />to Cabarrus County upon failure of the subdivider to complete the required <br />hnprovemenls within the allowed time.
