Paqe 12 <br /> <br /> it is a rezoning in which we are able to look at one <br /> particular use which is being presented, not a variety of <br /> uses, it is entirely possible for this Board to look at <br /> that use. If the Board feels it is appropriate a <br /> condition requiring that a detailed site plan that would <br /> have to come back before this Board for your review and <br /> approval prior to their commencemenb and construction <br /> could be imposed in that way, any concerns that the Board <br /> may have on it not fitting in properly, could be handled <br /> at that time. That is also a beneficial to the abpltcant <br /> because they do not want to go through extra expenses up <br /> front if it is going to be denied. Mr. Newton reminded <br /> the Board that with this special use process, in being <br /> able to put a condition on, the condition can only be <br /> recommended to the Board of Commissioners who would have <br /> to place it on after their official public hearing. But <br /> if they put that condition on ( i.e. to send it back to <br /> this Board for your review and approval), you know the <br /> use and you can address some of the issues here and you <br /> can be sure that the specifics are met so that it will be <br /> compatible with the surrounding area. <br /> <br /> · Mr. Grady stated it would be hard to come before the <br /> Board and know everything that each one of you wants to <br /> know. That is why he is asking what the Board wants to <br /> know. <br /> <br /> Mr. Hartgen said the problem as he sees it, is without <br /> the site plan the staff cannot check the existing <br /> setbacks, the elevation or runoffs, there are a lot of <br /> things they cannot check. <br /> <br /> Mr. Marshall stated if he could address that question <br /> briefly, this is a petition for rezoning. After the <br /> zoning, if it were approved, then the zoning compliance <br /> would still need to be obtained for construction and all <br /> that site plan review would take place. So that part of <br /> the process is already set up in the ordinance. <br /> <br /> Mr. Alexander stated he understands this special use <br /> section of the ordinance as saying, this is a unique time <br /> in the ordinance which gives you the ability, that is to <br /> make a recommendation to the County Commissioners and to <br /> put special conditions in the process. Me also stated as <br /> he understands it, the Board has three options, one is to <br /> recommend approval of the zoning classification change <br /> without conditions; two, to recommend approval of the <br /> zoning classification change with conditions, which would <br /> typically be that it must <br /> <br /> <br />
