3. Contract the services of Duke University Medical Center Division of Occupational Medicine/Occupational Health Services for a Medical Review Officer (MRO). Or. Kim Broadwell will be the designated MRO for client. If the CLIENT determines that the quality of the selected MRO service is not satisfactory, then an a].ternate MRO will be co~%tracted with by Wolfe & Associates for CLIENT. The selected MRO must be approved by the CLIENT. Services to be performed by MRO for CLIENT include: 3a. Review of urine drug testing results by a licensed doctor of medicine or osteopathy with knowledge of substance abuse disorders in accordance with guidelines and applicable State and/or other federal regulations. Such review will include (but is not limited to) evaluation of relevant medical records, medical history or any other relevant medical factors, consideration of relevant biomedical factors, and interview of the tested individual. Review for the presence or absence of five drugs will be executed: amphetamines, cocaine, marijuana, Opiates, and phencyclidine (PCP). 3b: The receipt of a result report from NIDA certified laboratory for one of CLIENT's employees or applicants for employment will initiate the review process; each specimen tested will constitute a single report. Receipt and review of the Urine Custody and Control form from the collection site will be necessary prior to reporting of a test result by MRO to CLIENT. 3c: CLIENT authorizes MRO to request specific information on the actual levels of drugs detected in individual specimens or to request retesting of individual specimens by the laboratory providing the initial test report or to have an aliquot of the sample sent to another NIDA certified laboratory for testing as deemed appropriate by MRO or as requested by CLIENT's employees or applicants for employment. 4. Reports of positive or negative results confirmed by review will be provided to designated CLIENT representatives (and to the tested individual by specific CLIENT request) by facsimile transmission, or U.S. Mail. Results will be reported as soon as review is complete. Attempts will be made to provide reports of results within 48 hours of receipt o~ results from the testing laboratory, but in no event will the time for reporting.be greater than that allowed be Federal and/or applicable state law or regulation, e×cept when circumstances beyond the control of the MRO prevent meeting such deadlines. CLIENT will maintain all records of test results. (2)
