He stated this is, as <br /> we see it, the only way they can expand their business (your livelyhood) <br /> and that is the process not only of the current zoning regulations but <br /> a)so that is the only process available, Mr. Newton said as he sees <br /> it, this is very appropriate that they are moving through in this process. <br /> It is a fair way for the applicant. Mr. Newton said a ~on-conforming use <br /> means it is not suppose to be in the zone that it is in. The rezoning <br /> request fits this piece of property and it will also allow their business <br /> to expand. <br /> <br /> There being no further comments, Mr. Nichols MOTIONED to approve Petition 90-11 <br /> zoning atlas amendment, seconded by Mr. Hurlocker. The vote was unanimous. <br /> <br />Chairman Randall introduced the fourth item on the Agenda, Zoning Text Amendment: <br /> <br />4. Applicant: Planning & Zoning Department <br /> Request: S_1~ecial Use District Zonin9 <br /> <br /> This was a request to the Cabarrus County Planning Board from the Cabarrus <br /> County Planning & Zoning Department, to add parallel special use zoning <br /> districts to the zoning ordinance. These districts will permit rezonings <br /> for specific uses and allow conditions to be applied to those rezonings. <br /> The amendment creates the special use zoning districts and sets up the <br /> rezoning procedures. <br /> <br /> Mr. Mike Downs, Zoning Administrator, stated to the Board that this is a <br /> continuation of the special use district that was presented at the last <br /> Planning Board meeting. Mr. Downs stated he would like to entertain any <br /> questions that the Board have. Mr. Downs also stated that as a St;~ff we <br /> are ready to move on with this if possible. <br /> <br /> Mr. Hurlocker asked Mr. Downs if the petitioner still has the option to <br /> come forward and proceed with a straight rezoning if this special use <br /> goes into place. <br /> <br /> Mr. Downs stated if a petitioner comes in for a rezoning, they have the <br /> option of going for the general rezoning which would include anything <br /> that is permitted in the proposed district. If they feel their chances <br /> would be better for that one particular use or a few uses they could <br /> choose this avenue to take. <br /> <br /> Mr. Hurlocker asked Mr. Downs from his prospective and from the planning <br /> prospective could, would and should they try to influence a petitioner? <br /> <br /> Mr. Downs stated the Staff would give the petitioners their options, <br /> and t~ll them the pros and cons of each one, but it is still the Petitioner's <br /> choice. Mr. Downs said the Staff cannot tell them they have to use this <br /> special use. <br /> <br /> Chairman Randall asked the Staff if it was advertised in the papers that we <br /> were going to be addressing these issues this evening. <br /> <br /> <br />
