It was publicized through the <br /> conversation Mr. Newton had with reporters from various newspapers. <br /> <br /> In response to general questions as to what would happen to the land's <br /> property value, Mr. Newton, Planning & Zoning Director, stated his <br /> experience with this type of a text amendment being used is actually <br /> opposite from what was being indirectly inferred. The developers who have <br /> come through this process were in the areas which he has worked and he <br /> is familiar. He said he has personally been involved in both processes. <br /> Mr. Newton said between 250 to 300 (and maybe higher) developers have <br /> gone through this special use process, and probably somewhere in the <br /> neighborhood of 200 for developers who went through straight rezoning. <br /> In no case has the special use process depressed property values. Rather <br /> they tend to increase due to the future degree of certainty as to what <br /> can and can not happen on the site. <br /> <br /> Chairman Randall stated she thinks this will be so beneficial if the <br /> Board agrees. The Board is going to be able to have petitioners come <br /> in with more specific concepts of development or uses in mind, instead <br /> of looking at all uses, the Board will be able to focus on a limited <br /> number and it's the petitioner's choice. She stated this is going to <br /> give the Board a lot more ability to decern the appropriateness of the <br /> petition. <br /> <br /> There being no further comments, Chairman Randall MOTIONED to approve <br />.. and adopt Petition 90-05(t) special use district zoning text amendment, <br /> seconded by Mr. Hurlocker based on the information that the Board is <br /> not eliminating any options, and both Staff and Board will consider <br /> all options. The vote was unanimous. <br /> <br /> Chairman Randall introduced the fifth item on the Agenda, Zoning Text Amendment: <br /> <br /> 5. Applicant: plannin9 &Zoniug DeRartment <br /> Request: 3.13 River/Stream Overlay Zone (~SOZ) <br /> <br /> This was a request to the Cabarrus County Planning Board from the Cabarrus <br /> CoUnty Planning & Zoning Department, to adopt the River/Stream Overlay <br /> Zone (RSOZ), to protect the County's water quality, protect the County's <br /> wetlands, and allow the County to use existing areas adjoining rivers or <br /> streams toward mitigation procedures required by several federal agencies <br /> in order to construct the Coddle Creek Reservoir. <br /> <br /> Mr. Mike Byrd, Planner, presented the River/Stream Overlay Zone (RSOZ) <br /> to the Planning Board for consideration. He stated this overlay district <br /> would allow the County to meet the wetland mitigation requirements for <br /> construction of the reservoir. After briefly reviewing the RSOZ text, <br /> Mr. Byrd asked the Planning Board if they had any questions on the RSOZ text. <br /> <br /> Mr. Hurlocker asked Mr. Byrd what kind of grade or slope would he be <br /> talking about to have a 120 foot buffer? <br /> <br /> <br />
