1SA NCAC 13B .0900 are proposed for adoption as follows: <br /> <br />SECTION .0900 - YARD TRASH COMPOSTING FACILITIES <br /> <br />.O901 PROCEDURE FOR PERMIT <br /> (a) A separate "Yard Trash Composting" permit will not be <br />required for a sanitary landfill facility which designates a yard <br />trash composting area within facility boundaries. Application and <br />operational requirements as set forth in .1303 and .1304 shall be <br />addressed in submittal for a sanitary landfill permit. <br /> (b) The seal of a professional engineer is not required when <br />submitting plans for a Yard Trash Composting permit. A minimum of <br />three sets of plans will be required in each application. <br /> <br /> ~istory Note: Statutory Authority G. S. 130A-309.11; <br /> Elf. December 1, 1990. <br /> <br />.0902 Applicability for Yard Trash Composting <br /> As of January 1, 1993, disposal of yard waste in a sanitary <br />landfill shall be prohibited; however, yard trash which has been <br />separated may be accepted at a sanitary landfill where the facility <br />provides and maintains a separate yard trash composting area. <br /> (1) Applicability. A permit is required for the construction and <br /> operation of composting facilities for yard trash which <br /> process more than 3000 cubic yards of material per year. <br /> Yard trash may be composted with agricultural waste and <br /> silvicultural waste as defined in .0101 of this Rule. The <br /> Section does not regulate the composting of agricultural <br /> waste and silviculture waste, unless mixed with yard trash. <br /> (2) Activities not requiring a permit. A permit is not required <br /> for the following composting operations: <br /> (a) Backyard Composting <br /> Farming operations where the compost produced is <br /> re-used on the owner's land and not offered to the public. <br /> (o) Facilities composting less then 3,000 cubic yards of <br /> material per year, meeting the following conditions: <br /> (i) Notification of the Solid Waste Section on an annual <br /> basis as to: <br /> A. Facility location; <br /> Bo Name of owner and operator; <br /> C. Address of owner and operator; <br /> D. Phone number of owner and operator; <br /> E. Type of waste received; <br /> F. Amount of waste received; <br /> G. Composting process to be used; and <br /> Intended distribution of the finished product. <br /> (ii) Agreement to operate in accordance with operational <br /> requirements as set forth in .1304 of this Rule, <br /> except for .1304 (7). <br /> (iii) Facility operates in accordance with all other state <br /> or local laws, ordinances, rules, regulations or <br /> orders. <br /> <br /> History Note: Statutory Authority G.
