the follo~ing: emplo~ent, upgrading, demotions or transfers; <br /> recruitment or recruitment advertising; layoffs or terminations; <br /> rates of pay or other forms of compensation; selection for training <br /> including apprenticeship; and participation in recreational and <br /> educational activities. The Center certifies that it presently has <br /> in effect such an affirmative action program. The Center agrees to <br /> post in a conspicious place available to employees and applicants <br /> for employment, notiqes setting forth the provisions of this <br /> non-discrimination clause. The Center shall in all solicitations or <br /> advertisements for subcontractors or employees placed by or on behalf <br /> of the Center state that the Center is an "Equal Opportunity <br /> Employer". (b) The Center shall keep such records and submit such <br /> reports concerning the characteristics of applicants for employment <br /> and employees as the Purchaser and the North Carolina Division of <br /> Aging may require. (e) The Center agrees to comply with such <br /> guidelines as the Purchaser or the North Carolina Division of Aging <br /> may issue ot implement the requirements of this paragraph. (d) The <br /> Center agrees to comply with Title VI and Title VII of the Civil <br /> Rights Act and Section 504 of the Rehabilitation Act. <br /> <br />14. Indemnity and Insurance. The Purchaser agrees to indemnify and save <br /> harmless the Center, its agents and employees from and against any <br /> and all loss, cost, damages, expense, and liability caused by the <br /> failure of the Center to fully perform its obligations under this <br /> agreement and in accord with its terms; or by an accident or other <br /> occurrence causing bodily injury, including death, sickness, and <br /> disease to any person; or damage or destruction cc property, real or <br /> personal, which may arise from operations, products or services <br /> rendered under this contract. <br /> <br />1da. Indemnity and Insurance.
