and all limitations on the liability of OCLC set forth in the OCLC <br />Agreement° <br /> <br /> 4.03. Disclaimer of Warranties. SOLINET GIVES NO <br />WARRANTY, EXPRESS OR IMPLIED, INCLUDING SPECIFICALLY, BUT NOT <br />LIMITED TO, THE WARRANTY OF MERCHANTABILITY AND T~E WARRANTY OF <br />FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO TErmINALS SUPPLIED <br />PURSUANT TO THIS AGREEMENT AND ANY AND ALL OTHER ITEMS OR MATTERS <br />COVERED BY OR RELATED TO THIS AGREEMENT. MEMBER HEREBY AGREES THAT' <br />SOLINET WILL NOT BE LIABLE FOR ANY DAMAGES, INCLUDING, BUT NOT <br />LIMITED TO, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM <br />MEMBER'S USE OF ANY TERMINAL SUPPLIED PURSUANT TO THIS AGREEMENT OR <br />ANY OTHER MATTER COVERED BY OR RELATED TO THIS AGREEMENT. <br /> <br /> 4.04. Site Preparation. Member shall be responsible <br />for site preparation with respect to any terminals furnished <br />pursuant to this Agreement and SOLINET shall furnish to Member, at <br />its request, any site preparation specifications applicable to <br />terminals furnished by SOLINET. Member shall, to the extent <br />permitted under the state law governing Member, reimburse SOLINET or <br />any vendor of SOLINET for any costs incurred as a result of untimely <br />or incomplete site preparation on the part of Member. <br /> <br /> 4.05. Other Terminals. Member may use a terminal not <br />furnished by SOLINET, that is approved in writing by SOLINET as <br />being compatible with the on-line catalog and telecommunications <br />system to which it will be connected.
