credited toward monthly billings of Member, if no discount se!ection <br /> is requested. <br /> <br /> 5.05. SubscriPtion PaYments in the Event o~ Default <br />or Cancellation. In the e,;ent of the expiration or cancellation of <br />this Agreement, pursuant to Section 11 hereof, or the termination of- <br />this Agreement, pursuant to Section 10 hereof, SOLINET will refund <br />to Member any unexpended subscription payments. <br /> <br /> 5.06. Overdue Accounts. A one percent (1%) per month <br />service charge shall be automatically assessed against any and all <br />charges which are not fully paid within thirty (30) days of date of <br />invoice. Notwithstanding the foregoing or any other provision of <br />this Agreement, it is the intent of the parties hereto that they <br />have not contracted for, nor will SOLINET collect,-service charges <br />of any amount or at any rate which exceed the highest lawful rate <br />prescribed under any law which a court of competent and final <br />jurisdiction may deem applicable hereto, and if the fulfillment of <br />any provision of this Agreement involves the payment of service <br />charges in excess of the limit prescribed by law which a court of <br />final and competent jurisdiction may deem applicable hereto, then <br />ipso facto, Member's obligation to pay service charges under this <br />Agreement shall be reduced to the maximum limit prescribed by law. <br /> <br /> 6. Taxes. SOLINET shall notify Member promptly of (a) any <br />tax assessed against SOLINET which is, in the view of SOLINET, the <br />obligation of Member; or (b) any tax which SOLINET is obligated, in <br /> <br /> -10- <br /> <br /> <br />
