CABARRUS COUNTY <br /> Post Office Box 707 <br /> CONCORD. NORTH CAROLINA 28025 <br /> <br /> STAFF ANALYSIS-PETITION 89-08 <br /> <br /> This petition for [ezoning has been made for the staltted <br />purpose of allowing both e second hand shop and the storage <br />of rental furniture on the same lot. Currently the second <br />hand shop is allowed as a rural home occupation, end the <br />storage of the rental furniture is not allowed. <br /> There are a number of factors that support the denial <br />of this petition. First and foremost, the current home <br />occupation use is in non-compliance because there are no <br />sanitary facilities in the commercial building, there is a <br />portable sign in the right-of-way of U.S. 601, and the <br />business is not complying with the Thoroughfare Overlay Zone <br />requirements ia terms of drive cuts. In addition to this, a <br />business on this Iooat ion may create traffic hazards due to <br />the property's proximity to the U.S. 601/Miami Ch. Rd. <br />intersection. The granting of this rezoning may also raise <br />questions of spot zoning as there are no other commercial <br />zones in the immediate area. <br /> There are but a few factors in support of this <br />rezoning. These include the fact that there are some <br />commercial uses and a fire station in close proximity to the <br />property, the property is located on a major tcansportation <br />facility, and the property is currently used for both <br />residential and commercial purposes. <br /> Staff recommends denial of this petition. <br /> <br /> <br />
