® State Solid Waste Management Plan (130A~309.07} <br /> <br />The Department of Environment, Health and Natural ResoUrces is <br />responsible for development of a statewide solid waste management <br />plan. This plan will serve as the framework for county management <br />plans required in other provisions of Section2. The state plan must <br />be developed by March 1, 1991. <br /> <br />· Cost Determination and Pees (G'.S. 130A-309.08) <br /> <br />- Counties and municipalities are required to make a determination <br /> of the full cost of solid waste management within their <br /> jurisdiction by October 1, 1991 or within one year of adoption of <br /> rules for cost determination by the Department, whichever is <br /> later. <br /> <br />- Within one year of making the cost determination, each local unit <br /> must provide e means of informing service users of the full cost <br /> of solid waste management at least one per year. <br /> <br />- Local governments are empowered to enact variable rate tipping <br /> fees based on the characteristics of wastes and may charge a <br /> service fee for recycling services. <br /> <br />· Local Government Responsibilities (G.S. 130A-309.09) <br /> <br /> Designated local governments (those operating solid waste <br /> facilities) are authorized to enact ordinances governing waste <br /> flow from outside their service areas. <br /> <br /> Local governments are authorized to charge fees for solid waste <br /> disposal, so long as the fees are applied in a uniform manner to <br /> all jurisdictions within the service'area. <br /> <br />- By July 1, 1991, each designated local government must initiate a <br /> recycling program which: <br /> <br /> i) Requires the separation of construction and demolition <br /> debris from the solid waste stream and disposal at a <br /> separate location. <br /> Requires the separation of recyclable materials for which a <br /> market exists from the waste stream. The determination of <br /> economic feasibility and market availability will be made by <br /> the state Department of Economic and Community Development. <br /> <br />- The local recycling programs must at%sin the statewide goal of <br /> 25% reduction in the waste stream by January 1, 1993. No more <br /> than half of the goal can be attained by separating yard trash, <br /> tires, white goods and debris. <br /> <br /> The Department of Environment, Health and Natural Resources may <br /> reduce or modify the 25%'goal for individual local units upon <br /> determination of adverse financial impact on existing obligations <br /> relating to waste-to-energy facilities. <br /> <br /> -OVER- <br /> <br /> <br />
