-7- <br /> <br />Section 3: Scrap Tire Disposal Act <br /> <br />· Scrap Tire Disposal Fee (130A-309.54, .55 and .56) <br /> <br /> Effective January 1, 1990, a 1% state sales and use fee is levied <br /> on all new tires purchase or used in North Carolina. <br /> <br />- Proceeds of the scrap tire disposal fee are to be divided as <br /> follows: <br /> <br /> 1) .90% distributed'quarterly to the 100 counties on a per <br /> capita basis. <br /> 2) 10% deposited in the Solid Waste Management Trust Fund. <br /> <br />· Scrap Tire Disposal Program <br /> <br />- By April 1, 1990, owners and operators of scrap tire collection <br /> sites must inform the Department of site locations and size as <br /> well as the number of tires accumulated. <br /> <br />- By July 1, 1990, all scrap tire collection and disposal sites <br /> must be permitted. <br /> <br />- By January 1, 1990, the Commission on Health Services must adopt <br /> rules to set standards for scrap tire disposal and for the <br /> permitting of sites. <br /> <br />· Disposal of Scrap Tires <br /> <br />- Each county is responsible for the disposal of scrap tires. <br /> <br />- Permissible methods of scrap tire disposal include: <br /> incineration, retreading, crash barriers, soil erosion control, <br /> chopping and shredding, crumbling for use in asphalt, tire <br /> derived fuel, and use in other products, slicing, sludge <br /> composting, cutting, stamping, oyster cultch, pyrolization, and <br /> monofilling. <br /> <br />- Effective March 1, 1990, landfilling of whole scrap tires is <br /> prohibited. <br /> <br />- Every county must include a description of scrap tire disposal <br /> procedures in the biennial plan required under G.S. 130A-309.04 <br /> (see page 2). <br /> <br />- Every county must provide a site for scrap tire disposal. The <br /> site can be operated directly by the county or provided under <br /> contract with another local government, a multi-county operation, <br /> or a private provider. <br /> <br />- The local disposal fees that counties (or their contractors) may <br /> charge are limited as follows: <br /> <br /> -OVER- <br /> <br /> <br />
