-8- <br /> <br /> 1) For in-county scrap tires, the county may assess a local fee <br /> only to the extent that actual cdsts per tire for disposal <br /> of scrap tires exceeds revenues received during the <br /> preceding 12 months from the 1% state scrap tire disposal' <br /> fee. <br /> 2) For manufacturers' and retailers' scrap tires, on which no <br /> state fee has been assessed, the county may chakge a fee <br /> equal to the cost.of per tire disposal. <br /> 3) For out of county tires, the local fee is at the discretion <br /> of the county or its contractor. <br /> <br /> Scra~ tire retailers and haulers are required to complete a <br /> certification form identifying the source and number of scrap <br /> tires. This form must be presented to the operator of the tire <br /> disposal, collection or reprocessing site. <br /> <br /> · Tire Hauler Registration (130A-309.59) <br /> <br /> All scrap tire haulers must register with the Department of <br /> Environment, Health and Natural Resources. Haulers will be issued an <br /> identification number by the Department. <br /> <br /> · Nuisance Tire Collection Sites (130A-309.60) <br /> <br /> Effective July 1, 1990, all tire sites identified as nuisances must be <br /> closed within 90 days. Certain facilities are exempt from this <br /> provision, including solid waste facilities where less than 60,000 <br /> tires are stored at one time. <br /> <br /> · Preemption (130A-309.61) <br /> <br /> Any local ordinance regarding scrap tire disposal which is <br /> inconsistent with provisions of the Scrap Tire Disposal Act is <br /> preempted. <br /> <br /> · Fines and Penalties (130A-309.62) <br /> <br /> Violations of scrap tire disposal requirements are subject to civil <br /> penalties of $50.00 per tire. <br /> <br /> Section 4: Repeal of G.S. 90-113.4A <br /> <br /> The lawgoverning disposal of syringes and needles is repealed <br /> effective October 1, 1989. (The Department must develop medical waste <br /> rules by August !, 1990.) <br /> <br /> Section 5: .Amendments to G.S. 120 <br /> <br /> The law is amended to permit consideration by the General Assembly <br /> during any session of proposed legislation to implement <br />· recommendations from the Environmental Management Commission <br /> concerning studies by the Environmental Review Committee. <br /> <br /> <br />
